OUTLINE OF CASE SINCE ANNUAL ELECTION O F D18T. NO. 1, JULY. I t t t . Editor Lowell Ledger: The case of Grace B. Walker vs. Perry C. Peckham was tried in the circuit court on Monday and Judge Perkins, presiding, ruled that the claim of Miss Walker was not well founded. Her petition to be placed on the board of education was dismissed and the position taken by the board sustained^ At the annual school meeting of last July. Miss Walker was apparenty elected, she having received the largest number of votes, but her qualilications were not held sufficient. The law provides that to be a member of the board of education in a graded school district, that one must be an elector in said district, his name must appear upon the assessment roll at the tiige of election and he must own in nis own right the property so assessed. The board of education was informed soon after election that Miss Walker did not own any real estate and that h e r name was not on the assessment roll, and on her refusal to sign the affidavit setting up these facts as provided by law. the board took the matter up with the attorney sneral and superintendent of pubc instruction. O. J. Yeiter. president of the Upard. made a t r i p to Lansing for this purpose before any action was taken by the board. The superintendent of public instruction gave the board written instructions that it should not accept Miss Walker on the board under the circumstances and the board followed the written Instructions of Mr. Hoffius. prosecuting attorney. and 'he attornev general of the state of Mich!am in making the appointment to All vacancy. As brought out at the trial. Miss Walker's name was not on the assessment roll at the time of election, but about nine days later Supervisor Yeiter erased the name of Clarissa Walker a n d inserted with lead pencil the name Grace Walker. This was done at the request of Miss Walker or by another acting as her agent. From the testimony it was further shown that Miss Walker did not at the lime of election own this prop* erty or any other real estate. The real estate which was changed to her name on the roll still belongs t o her father's estate, he having died many years ago and there are three surviving heirs. The board of education at its meeting August 27. over a month a n d one half after the election and after being fully advised by the attorney general, superintendent of public instruction and prosecuting attorney, ippointed Perry C. Peckham to ffll the vacancy, he having received the next highest number of votes at the election. Judge Perkins In rendering his de cision voiced his regret at this mat ter having been brought into cAirt. He ruled that the laws providing qualifications of school officers must be strictly construed, and that Miss Walker was not qualified f o r two essential reasons: First, that her name was not on the assessment roll at the time of election, second, that she did not then or now own proper ty in her own right. The board of education has made every effort to make each and every step taken In this action correct and has made each move under the directions of the highest legal and school authorities in the state. Their acts in the entire matter and the appoint* ment of Mr. Peckham was full> sustained by the court.—[Com.

There may be some old residents n the south part of the township of Lowell about Morse Lake and Whitneyville whose memory will reach back to about the year 186U and recall a peculiar character, a PottawattomieIndian named Tanner, who was there. In those davs there was an old-time tavern and Its barroom at Whitneyville which Tanner patronzed, and when 1 was yet a small toy they used to point out scars on top of the bar made by whiskey glasses in the hands of this child of nature in some of his drinking bouts. Tanner was a big, stalwart fellow, and when full of firewater he used t o make things howl around the old tavern. My father at one time ran a sawmill down there and relates many wild stories of the natives who in those days inhabited the rountry about Thornapple creek. At the time my parents arrived in Michigan, 1863, Tanner had reiormed and given up his drinking habits and was preaching. 1 remember him as conducting protracted meetings in the old schoolhouse at Morse's corners and the upen-eyed wonder with which we kids I'Kiked upon our first Indian. Tanner was some "pulpit-pounde r " of the old school. His ponderous frame and voice that could be heard across many acres was enough to i a r the rafters loose in that old institution of learning and cause the worst sinner to see the error of his ways And in his religious fervor he seemed lust as earnest and sincere as in the days before his reformation when he was serving the devil and causing the people of Whitneyville to lock and double-bar their doors when he held "services" in the old tavern. The uresentation of the Senior play "Welcome Home, Jimmy, at the City hall was well received l>y large and anpreciative audiences. Music was furnished before the play and between acts by the IliKh School orchestra. Mr. Clark gave a clever Scottish skit and the Boys' (ilec club sang the recent song hit "It Ain't a lioin* to Bain No More." The members of the cast took their parts well, each person fitting the roll which he or she represented. Alma Wingeier as "Peggy" took In an excellent manner the par! of a saucy )jirl of Iti. Stanley Taylor's drawl was ideal for a country boy. As George Pierce, Crandall Flogaus made a ^ i m h I country lawyer. Margaret Marsh carried her part well as the old maid. Hosella Lipk was a kindly, partially helpless old ladv. Her part was done very natiirally. Frieda Wittenbach made a very vivacious maiden of twentv.
