Bureau of Automotive Repair Shuts Down Five Northern California Purrfect Auto Service Shops Investigation finds pattern of abuse and willful misconduct The Bureau of Automotive Repair (BAR) suspended the Automotive Repair Dealership (ARD) registrations of five Purrfect Auto Service shops, effectively shutting them down temporarily, after an investigation found evidence of a pattern of abuse and willful misconduct. BAR sought, and was granted, an Interim Suspension Order (ISO) affecting four shops in Sacramento and one in Fairfield, all of which are suspected of numerous violations of the Automotive Repair Act. The alleged violations include charging for parts and/ or services that were not needed and in some cases not provided, making false or misleading statements, and departing from accepted trade standards. continued on page 4

Holding Government Accountable Through Transparency in Decision-Making Public participation and collaboration are keys to success Every year, policymakers in every level of government make decisions that affect practically every aspect of our lives — from the water we drink to the medical care we receive. The impact these decisions have on our pocketbooks and the quality of our lives is enormous. In a democracy such as ours, our collective success depends, in part, on government providing the public with information about policy changes under consideration. By making this information accessible, the public can effectively contribute ideas and expertise to help ensure successful implementation of these policies. With this in mind, the Bureau under my direction has posted a tremendous amount of information on our Web site, which is updated daily. The Web site was also redesigned continued on page 8
BAR Continues to Move Forward on Smog Check Licensing Restructure Regulations expected to be adopted in 2012 It’s often said that Smog Check stations and the technicians they employ serve as the face of the Smog Check Program. Consumers who patronize stations that employ technicians who can answer their questions, efficiently test a vehicle, and can successfully perform repairs are more likely to have a positive impression of the Smog Check Program and comply with the requirements of the law. With the needs and demands of the marketplace in mind, the Bureau of Automotive Repair (BAR) has been working over the past year to develop a strategy to improve the existing structure for licensing Smog Check technicians without compromising vehicle emissions reduction goals. Conceptually, BAR seeks to implement a structure whereby a technician’s qualifications would be specific to the services for which they are licensed to provide, and stations would be able to choose the technicians whose qualifications best meets their needs. Licensing paths would be available for highly skilled and proficient technicians as well as for those with less experience. Part of the restructuring process involves soliciting public input and comments. BAR staff have held a number of workshops with industry representatives, licensees, business owners, and BAR-certified instructors and schools. Workshops were held throughout the state, including Marysville, Los Angeles, Hayward, and Sacramento. The reception to BAR’s proposal has been positive. Many industry representatives see it as a natural step that meets the needs of both the industry and the marketplace. There were, however, some concerns about the initial concept, and BAR responded with some revisions. For example, initially BAR wanted all repair technicians to have ASE A-6 A-8 and L-1 certification. Based on industry input, BAR added an education with experience option. Also based on industry input, an inexperienced inspector candidate must pass a competency assessment to qualify for Smog Check training. Many of those who initially had concerns are now in favor of the plans. “I’m really excited about this proposal because we’ve heard so much from industry and technicians about having a licensing structure that reflects the needs of the marketplace,” notes Patrick Dorais, Deputy Chief of BAR. “The real beauty of this proposal is that it really does

protect the consumer without compromising emissions reduction goals,” he adds. This restructuring proposal is important to technicians, businesses, and BAR. Consumer Assistance Program Expands Motorists can now retire a vehicle at any time, for any reason Few programs are more important to California in removing unwanted, high polluting vehicles than the Consumer Assistance Program (CAP). Since its inception, CAP has retired thousands of vehicles, removing hundreds of tons of emissions from our air annually. Although the success of CAP is undeniable, continued success has been hamstrung by certain program requirements. Previously under CAP’s vehicle retirement option, eligibility to participate was limited to, among other things, consumers who owned a vehicle that failed a biennial Smog Check inspection. With the passage of Assembly Bill (AB) 118 (Chapter 750, Statutes of 2007), the rules for participating in vehicle retirement have changed. Effective August 2010, a consumer can retire a vehicle at any time and for any reason, as long as they meet program requirements. Vehicles no longer need to fail a biennial Smog Check inspection. Consumers can also retire a pre-1976 model year vehicle. These vehicles can be retired at one of over 30 dismantler sites under contract with the Bureau of Automotive Repair (BAR).
BAR has also added a voucher component to CAP. Under this element of CAP, BAR notifies consumers of high polluting vehicles about their eligibility to receive either $2,000 or $2,500, depending on their annual income, toward the purchase of a lower emitting vehicle or transportation passes from a local transit district. Vouchers will be administered initially in the San Joaquin Pollution Control District and the South Coast Air Quality Management District. Eventually, vouchers will be offered to consumers statewide. “CAP has gone through a lot of changes over the years, but it’s never been anything like this,” states Tonya Blood, CAP manager. “Retiring a vehicle and helping clean the air have never been easier. BAR’s commitment to clean air has never been greater. I’m really proud to be part of this effort,” she adds. BAR is promoting these changes by targeting consumers through BAR’s DriveHealthy campaign and the Web site. As always, consumers can submit an application for processing at any one of BAR’s 12 field offices. Applications are processed on the spot. Advertising Malfunction Indicator Light Diagnosis The Bureau of Automotive Repair (BAR) has noticed an increase in the number of consumer complaints regarding auto repair shops that are advertising free or low-cost Malfunction Indicator Light (MIL) diagnoses. Some shops use their scan tool to retrieve the Diagnostic Trouble Codes (DTC), then tell the customer that there is an additional charge to diagnose the problem. This is considered a “bait and switch” tactic because most vehicle malfunctions that will set an MIL cannot be diagnosed by simply retrieving and identifying the DTCs. For example, a simple misfire code might require a secondary ignition diagnosis, a fuel delivery diagnosis, and an engine compression/cylinder leak-down test. These advertisements also do not meet the minimum disclosure requirements for price advertising set forth in California law. Advertisements with the words “diagnosis,” “analysis,” “inspection,” or any other similar terms must follow the industry recognized diagnostic procedures necessary to determine the specific causes of the DTCs and then advise the customer. Shops that do not perform these procedures for the advertised price
should disclose that they will likely not identify the specific problem(s) that set the light. It is important to note that when a vehicle fails a smog inspection, only licensed Smog Check Test-and-Repair stations can perform the diagnoses and repairs, which must be performed by a licensed Smog Check technician.

Revised Smog Check Program Inspection Procedures New procedures simplify the inspection process In January 2010, regulations were adopted that incorporated a revised Smog Check Inspection Procedures Manual. Some of the major changes are as follows: >> Diesel-powered vehicles that are model year 1998 and newer with a 14,000 Gross Vehicle Weight Rating and less must be inspected biennially and during change of ownership. Inspections require a visual check of emissions control components, a visible smoke test, and an onboard diagnostic functional test. Additional details and training materials are available at www.smogcheck.ca.gov. >> Gasoline-powered vehicle visible smoke test: A BAR Snap Test sequence has been added to the gasoline
vehicle smoke test. The BAR Snap Test requires the technician to quickly push-and-release the accelerator pedal from the idle position to between 2,000 and 3,000 RPM, then immediately allow the engine to return to idle. >> Fill pipe restrictor test: The fuel tank fill pipe restrictor test and dowel gauge tool are no longer required. >> Deletion of the fuel cap test: The fuel cap functional test is no longer required on model year 2000 and newer vehicles. >> Deletion of the EGR functional test: The EGR functional test is no longer required on 1996 and newer model year vehicles. A Message from the California Air Resources Board
Violations in Clean Air Laws Result in Large Settlements Thousands distributed to community colleges and clean air fund The California Air Resources Board (ARB) distributed more than $86,000 to community colleges and a State clean-air fund in April 2010 as a result of settlements with companies that violated clean air laws. The violations included failure to conduct smoke inspection tests, comply with trash truck regulations, and install certified emissions reduction equipment on diesel engines. “Diesel emissions are a serious health threat to those who live — and work — near these vehicles,” said ARB Enforcement Chief James Ryden. “Compliance with state rules ensures that these emissions are kept in check. We’re glad that these settlements will benefit community colleges and clean-air research and education.” These settlements, totaling $86,100, will be distributed to the California Air Pollution Control Fund and the Peralta Community College District. The fund will receive $64,575 for projects and research to improve California’s air quality. The remaining $21,525 will go to the college district to fund emissions education classes conducted by participating California community colleges around the state.

In 1998, California identified diesel particulate matter as a toxic air contaminant based on its potential to cause cancer, premature death, and other health problems.
Ensure Proper Vehicle Diagnoses and Repairs — Check TSBs, SSMs and Recalls The Bureau of Automotive Repair (BAR) Consumer Assistance Program (CAP) routinely conducts post audit reviews of repairs performed by Gold Shield stations. In the course of conducting those reviews, BAR has determined that it is not uncommon for technicians to overlook Technical Service Bulletins (TSBs), Special Service Messages (SSMs) and manufacturer recalls when diagnosing and repairing a vehicle. Failure to consult those resources can result in stations performing unnecessary and costly repairs.

This TSB provides information on diagnosing the root cause of poor engine performance, rough idle, stalls, engine cranks no start and possible P0300. The vent screens in the base become clogged causing excessive corrosion inside the distributor causing the misfire. The A/C line runs above the distributor and condensation drips onto it. This TSB later became recall 05500.

Some codes will not illuminate the Malfunction Indicator Light (MIL) causing a Smog Check failure and capture freeze frame data. These codes are not the direct result of an exhaust emissions failure and will not show on the emissions inspection system if they are the only code stored.

Description These vehicles utilize a ported type of EGR system wherein each cylinder has an individual port to feed the exhaust gas. When one or more of the ports become restricted or plugged, the remaining open ports are fed excess exhaust and can cause a misfire. Since exhaust gases are inert, they cause the cylinders with clear ports to be too rich. Hesitation, stumble, and high levels of HC and CO may cause an emissions failure.

Yet access to information means nothing if the public does not have an opportunity to share their ideas, expertise, and insight. That’s why I hold quarterly Bureau advisory group meetings. These meetings, which are open to the public, provide an excellent forum for consumers, industry representatives, and licensees to hear and discuss issues that may affect them. They also provide an opportunity to clarify and enlighten. Information about these meetings is posted on BAR’s Web site. I understand that schedule conflicts often prevent individuals from attending these advisory meetings. That’s why every year I accept dozens of invitations to speak at events sponsored by industry members, technical schools, and consumer associations. When I am unable to attend an event, I will send staff, many of whom are recognized leaders in the field of consumer protection and vehicle emissions reductions. If you have

The opportunity to learn about the Bureau and to share your ideas is not limited to advisory meetings and speaking engagements. Every year, Bureau staff work to develop regulations affecting various aspects of the Smog Check and automotive repair industries. BAR has utilized these workshops to garner public input, most recently on a proposal to restructure the licensing of individuals under the Smog Check Program. The Bureau has held other workshops involving the testing of dieselpowered vehicles and implementation of a visible smoke test. Public input during these workshops was invaluable. Information about future workshops are always posted on BAR’s Web site and sent through electronic transmission notifications. The issue of transparency in government is something I take seriously. Suggestions for improving this transparency are always welcome.
