FEARNE COTTON ‘HAPPY’ QUOTES COMPETITION – FULL TERMS AND CONDITIONS Introduction The prize for the winning entries selected will be: Reproduction of your ‘what makes me happy’ quote to be included in HAPPY by Fearne Cotton, to be published on 9 February 2017 by Orion Spring, an imprint of The Orion Publishing Group Limited, HB ISBN 9781409169413, Ebook 9781409169420, and in any further editions of HAPPY by Fearne Cotton published by or under license from the Promoter (the “Prize”). References to the “Entrant” are references to the author of the Entry (as defined below) that is submitted to this competition. References to “Promoter” are references to The Orion Publishing Group Limited, Carmelite House, 50 Victoria Embankment, London EC4Y 0DZ These Terms and Conditions apply to the “Fearne Cotton HAPPY” competition (the “Competition”). By entering this Competition, the Entrant agrees to accept and be bound by these Terms and Conditions and by the information in the promotional announcement. All entry instructions form part of the Terms and Conditions of this Competition. How to Enter In order to enter the Competition, each Entrant should submit via Twitter or Instagram an original ‘what makes me happy’ quote of not more than 10 words tagged with #WhatMakesMeHappy (the “Entry”). In addition to the entry method explained, participants may alternatively send an email with the participant’s name, address, phone number and email address to
[email protected] with the specified subject line “Fearne Cotton HAPPY”. Entries will not be accepted if submitted via agents, third parties or in bulk. The final date on which The Promoter will accept entries is 11:59pm BST on Friday 7th October 2016 (the “Closing Date”), so please ensure that the Entry reaches us on or before this date. Each Entrant may submit one Entry only. Second or subsequent entries will be disqualified. Any Entry that does not comply with these Terms and Conditions will not be accepted by the Promoter. There is no purchase necessary to enter this Competition. The Promoter reserves the right to alter or cancel the Prize without notice. The Prize is non-transferable and no cash alternatives to the prize will be provided. The Promoter is not responsible for contacting Entrants who provide unclear or incomplete information or for entries lost, misdirected, delayed or destroyed. The Promoter reserves the right to terminate, amend or extend this promotion without incurring liability, in the event circumstances affect its ability to operate the promotion. In the event of unforeseen circumstances, The Promoter reserves the right (a) to substitute alternative prize of equivalent or greater value to the Prize and (b) in exceptional circumstances to amend or foreclose the competition without notice. The rules of this competition shall be governed by and construed in accordance with the laws of England and the courts of England shall have exclusive jurisdiction in relation to any disputes arising therefrom. By submitting an entry you confirm that you are 18 years of age or older, and that you have read and accepted the terms and conditions. Conditions of Entry Entrants must be aged 18 years or over and resident in the United Kingdom, excluding Northern Ireland, and must not be employees of the Promoter or any of its affiliated companies, their families or agencies or anyone professionally connected with the promotion. The Promoter reserves the right to verify the eligibility of participants. You warrant to the Promoter that the Entrant’s Entry is original to the Entrant; does not infringe copyright or any other intellectual property right; does not defame or violate the privacy rights of any third party and does not infringe any other legal rights, regulations or laws. In entering this Competition the Entrant hereby grant to the Promoter an exclusive, perpetual, irrevocable, royalty-free, worldwide licence of all copyright and rights in the nature of copyright subsisting in the Entry in any part of the world to which the Entrant is, or may become, entitled (the “Licence”). You, being the sole author of the Entry, shall waive all moral rights in respect of the use to be made of the Entry under this Licence to which the Entrant may now or at any future time be entitled under the Copyright, Designs and Patents Act 1988 or under any similar legislation from time to time in force anywhere in the world. In particular, under the Licence, the Promoter may:
Reproduce the Entry in whole or in part in any media format, including but not limited to print, digital publishing, and audio;
Reproduce the Entry in whole or in part in any advertising or promotional material associated with this competition; and
Grant sub-licences of the Entry to publish the Entry in whole or in part in any media format, including but not limited to print, online and digital publishing.
Subject to the Licence, the Entrant will retain the legal ownership of the copyright in their Entry.
By entering this competition you agree that your name and country of residence may be published by the Promoter against the Entry wherever it is reproduced by the Promoter and the Entrant hereby grant to The Promoter an exclusive, worldwide, irrevocable, royalty-free licence in the copyright and all other rights in the nature of copyright subsisting in the photograph submitted with the Entry. Prizes and Judging After the Closing Date, the Promoter will select at its absolute discretion up to 50 winning Entries. Those selected will be informed by the Promoter on or before 9th February 2017 via a list on the Orion website, which Fearne Cotton will tweet a link to. Jurisdiction These Terms and Conditions are subject to English law and the exclusive jurisdiction of the English courts.
