F

orensic mental health assessment (FMHA) refers to the practice of performing mental health evaluations to assist courts and attorneys in the process of deciding certain matters of law applied to criminal, civil, or juvenile cases. The legal system’s use of FMHA—typically by psychologists and psychiatrists—has grown substantially during the past 25 years. It is important that both mental health and legal professionals understand the role these evaluations play in this process. Before focusing on specific legal questions in which FMHA may be useful, it is important to consider how FMHA is defined more broadly. It is also valuable to understand the relevant sources of authority that guide, allow for, and restrict the use of FMHA in legal decision making. This chapter will describe foundational aspects of FMHA that are distilled for legal professionals. Unlike the other chapters in this volume, each of which focuses on a specific legal question, we address the broadly applicable considerations in FMHA. We begin by describing FMHA and defining key components. We also identify important sources of authority—law, science, ethics, and practice—that contribute to our focus on best practice. Broadly applicable principles of FMHA are described, as are other influences that can help attorneys to identify best practice (and good practitioners) in this area. T H E N AT U R E O F F M H A What is FMHA? One way to describe it is to examine the types of cases for which FMHA is used. A second way is to describe how FMHAs differ from general clinical assessments. Defining FMHA as a Domain of Assessments As a practice, FMHA can be defined in part according to the types (or domain) of mental health

assessments for courts. Modern texts have identified that domain (Appelbaum & Gutheil, 2007; Goldstein, 2003, 2007; Grisso, 2003; Heilbrun, 2001; Melton, Petrila, Poythress, & Slobogin, 2007; Rosner, 2003) and have provided two ways to describe it. One way is to classify assessments based upon their relevance for cases in various systems of justice. First are evaluations in criminal and delinquency cases, ranging from various criminal competencies (such as capacity to waive Miranda rights) to issues of insanity and questions arising in sentencing. The second category is evaluations for cases in civil courts, frequently requiring evaluations to determine the presence and relevance of mental disabilities for legal questions regarding individuals’ care, protection of their rights, and adjudicating claims regarding injuries and illnesses. Some of these are civil evaluations pertaining to children and their welfare, such as evaluations for abuse and neglect or child custody. The third category includes issues involved in both criminal and civil systems (e.g., jury selection, eyewitness identification). Another way to classify assessments in the FMHA domain involves the nature of the tasks required by the assessment. In this classification scheme, the first category includes assessments in which the task requires a discovery of the mental state, motivations, attitudes, and behaviors of individuals at some point in time in the past that is relevant for the legal question. Examinees’ current mental conditions and abilities are relevant in these cases, but they are not determinative because often they do not directly address the legal question of mental states and abilities at a time in the past. The second category involves assessments that describe an examinee’s current mental status and abilities associated with a legal question about one’s present capacities to function in some specific

context. The third category focuses on estimates of the likelihood of behaviors, mental capacities, and functioning in the future. The objectives of assessments in the second and third categories are not always distinct. For example, while competence to stand trial focuses primarily on present functional abilities, the likelihood that those abilities will be sustained across the future duration of the trial enters into the assessment. This is even more the case for custody evaluations, where present parenting abilities are evaluated in order to make inferences about future parenting. A Conceptual Definition of FMHA Examining the term “forensic mental health assessment” offers another way to define FMHA that is more conceptual in nature. What is meant by “forensic”? What does the term “mental health” imply regarding the nature of FMHA? What makes FMHA different from general mental health assessment as a practice and a subspecialty? “Forensic” Mental Health Assessment The term “forensic” is often defined as pertaining to or employed in legal proceedings or argumentation. FMHAs are therefore assessments that are used in legal proceedings. Yet there are several ways one could interpret that assertion. A first claim may be that the definition of forensic allows any assessment to be a forensic assessment as long as it is used in a legal forum. For example, if a clinical psychologist performs an assessment of a patient in the course of ordinary clinical treatment, and if the clinician is subpoenaed at some later time to describe that assessment in a legal proceeding involving the examinee, our dictionary definition could call this a FMHA. In contrast, many authorities in forensic psychiatry and psychology would not consider this to be a FMHA, as they limit the scope of the concept to assessments that were performed with the intention of being used in a legal proceeding. Specifically, FMHA consists of “an evaluation that is performed . . . as part of the legal decision-making process, for the purpose of assisting the [legal] decision-maker or one of the litigants in using relevant clinical and scientific data” (Heilbrun, 2001, p. 3). Using this second interpretation, an assessment is considered forensic not because its results become evidence in a court, but because the assessment was undertaken specifically in order to produce evidence that would be

used in court. There is little to be said in support of the first interpretation, because it has no particular value. Calling any assessment “forensic” simply because it has been used in court does not advance our knowledge about how to do assessments that will maximize their usefulness to courts. Moreover, it creates a class of assessments based merely on where they are used, not what they are. The fact that a FMHA is performed with the intention of assisting legal decision makers has significant implications. A forensic assessment is guided by the specific legal question facing the legal decision maker. For every type of FMHA, there is a body of law controlling the legal decision to be made. The examiner performing the assessment should know the relevant law within the jurisdiction in which the assessment is being performed, as well as the legal question. The examiner then determines the types of data that are relevant for that legal question and develops an assessment procedure that is designed specifically to obtain those data. Stated another way, the legal issue forms the referral question for a FMHA. Most referral questions leading to forensic evaluations are quite different from the referral questions encountered in general clinical practice. General clinical assessments typically focus on identifying clinical needs and formulating interventions in the best interest of the patient. In contrast, forensic assessments focus on helping a legal decision maker decide whether an examinee has certain capacities, abilities, or behavioral tendencies that should be considered in order to decide how to resolve the legal question. Assessments for competence to stand trial, for example, may need to identify a defendant’s clinical profile, but primarily for the purpose of identifying specific deficits in abilities that the law defines as relevant for participating as a defendant in a trial. This definition has important implications for professionals who conduct FMHA (Melton et al., 2007). First, it requires knowledge and experience in translating the law’s definitions of relevant abilities and conditions into concepts that are amenable to psychological and psychiatric investigation. For example, laws that define competence to stand trial refer to “the capacity to assist counsel.” A FMHA that is designed to provide information related to that legal concept must first translate it into more specific abilities that the expert can observe and measure (see Chapters 2 and 16).

Foundations of Forensic Mental Health Assessment Second, the relation of the FMHA examiner to the examinee is different from that of the clinical examiner assessing a patient. General clinical assessments occur within a doctor–patient relationship directed toward the best interests of the patient. In contrast, the FMHA examiner’s primary allegiance is to the legal process and its decision makers, not to the examinee. This distinction leads to many differences between FMHA and general clinical assessments in the ethical obligations of examiners. This is discussed further below. Third, the distinction between forensic and clinical evaluations has implications for communication of one’s assessment results. Clinical assessments typically are performed to inform other clinicians. Forensic assessments, however, must inform non-clinicians, often judges, attorneys, and jurors, who need the information translated for use in a non-clinical context. FMHA results must therefore be interpreted and described in very different ways than clinical evaluations, according to a set of legal rules that were not designed according to medical or psychological models for the description of human behavior. Forensic “Mental Health” “Assessment” The term “mental health” is used to distinguish forensic psychiatric and psychological assessments from other types of forensic assessments, such as forensic science and forensic accounting. The inclusion of “mental health” as a modifier does not restrict FMHA to assessment of the presence or absence of mental disorders. Included in FMHA are assessments of various mental states, psychological phenomena, and behavioral predispositions that are relevant for legal questions about human behavior but are not symptoms of mental illness. The term “psychological” would come closer to identifying the questions that FMHAs address, but its use would have the disadvantage of appearing to restrict FMHA to performance by psychologists, while the assessment of psychological phenomena is performed by psychiatrists and social workers as well. The term “assessment” anchors FMHA in scientific and clinical methods of mental health professionals’ evaluations of individuals. The forensic nature of FMHA involves different referral questions than those that direct general clinical assessment, but the two fields have a methodological similarity rooted in the essentials of assessment. Hallmarks of assessment in psychiatry and psychology have included a

reliance on objective observation and the support of theory and empirical research when interpreting data to arrive at useful inferences. Historically, the general field of mental health assessment has evolved to favor systematic procedures designed to (a) obtain specific types of information, (b) use standardized methods that mitigate examiner bias, and (c) engage in interpretive processes guided by past research on the mental states or behaviors at the heart of the examiner’s inferences. FMHA not only conforms to those values, but also tends to elevate those values to a higher standard than in general clinical practice, due in part to the gravity of the legal decisions for which FMHAs provide guidance. In summary, FMHA is defined as a domain of assessments of individuals intended to assist legal decision makers in decisions about the application of laws requiring consideration of individuals’ mental conditions, abilities, and behaviors. These schemes represent the most useful definitions for legal professionals wanting to understand the various types of assessments typically carried out by mental health professionals in the forensic context. Such assessments should be guided by a set of standards to which mental health professionals aspire, drawn from all relevant sources of authority involved. We turn now to that objective. R E L E VA N T S O U R C E S O F AU T H O R I T Y F O R D E V E L O P I N G B E S TP R A C T I C E S TA N D A R D S Forensic psychology and forensic psychiatry have evolved over the past 100 years to the point that each is now recognized as a specialty. This evolution really began to crystallize in the 1960s, as it was during this time that a critical component for defining FMHA began to emerge—the notion that a general clinical assessment was not enough in forensic cases. Clinicians were beginning to assert that performing evaluations to inform legal decision makers required a logic and process that modified ordinary clinical methods in order to maximize their relevance for legal questions. Forensic psychiatry and psychology have become specialties only relatively recently. Although there are no specific data, it is probable that most psychologists and psychiatrists performing FMHA today were not trained as forensic specialists. Postdoctoral training in forensic mental health practice emerged only in recent years. Thus it is not surprising that the

quality of forensic evaluations has been to shown to vary widely (e.g., Borum & Grisso, 1995; Heilbrun & Collins, 1995; Heilbrun, DeMatteo, Marczyk, & Goldstein, 2008; Horvath, Logan, & Walker, 2002; Nicholson & Norwood, 2000; Ryba, Cooper, & Zapf, 2003; Skeem & Golding, 1998) and that the methods used by experts in conducting FMHA vary considerably (Heilbrun, 2001; Horvath, Logan, & Walker, 2002; Lally, 2003). The ethics codes of the American Psychiatric Association and the American Psychological Association nevertheless make it clear that anyone practicing within a specialization must be competent to do so. All clinicians are expected to practice only within the boundaries of their expertise. Interpretation of this mandate, of course, requires standards that define necessary training, as well as what it means to practice competently. To describe those standards, one must consider the sources of authority that contribute to the development of a best-practice standard. These sources include the law, knowledge based upon the behavioral and medical sciences, professional ethics, and professional practice. Law as a Contributor to Best-Practice Standards A major factor that sets FMHA practitioners apart from clinical psychologists and psychiatrists working as treatment and assessment professionals is the need to rely on the legal system—statutes, case law, and administrative code—to shape the assessment itself and to structure the focus of the report and testimony. The law also determines who is an expert in legal cases, the admissibility of an expert’s testimony, and the practices of experts conducting FMHA both within and across states (see Ewing, 2003, for a more comprehensive discussion of the relevance of law to FMHA). The Law: Defining the Focus of FMHA The law serves to regulate human behavior, and experts in the behavioral sciences may be called upon to assess a variety of concepts that may underlie, explain, or mitigate behaviors that result in a legal proceeding. The findings of these evaluations are used to provide information to the trier of fact, data that go beyond the scope of knowledge of the trial judge or the average juror. As legal terms are not synonymous with psychological concepts, the FMHA expert cannot conduct an evaluation without a reasonable understanding of

the elements of the legal referral question that has led to the referral. Forensic assessments must be relevant to the legal issue (Grisso, 2003), so the forensic mental health expert must collect data on mental health and behavioral concepts that are conceptually related to the legal standard. For example, in cases addressing legal competencies like competence to stand trial, testimony that describes only diagnoses or symptoms usually will not provide courts what they need to address forensic questions, especially since “the law does not presume that any psychiatric diagnostic condition is synonymous with any legal incompetency” (Grisso, 2003, p. 12). It is important, therefore, that the forensic mental health expert possess a thorough grasp of the legal underpinnings that drive the FMHA. It is also important for the attorney to seek to retain mental health professionals who have such knowledge of the applicable law and forensic process, typically acquired through training in and experience conducting such evaluations. The Law: Deciding Who Is an Expert To testify as an expert witness, the law requires that the mental health professional be accepted as such by the trial court judge. Although an attorney may retain a psychologist or psychiatrist as an expert, it is the court that determines whether this person can offer courtroom testimony. The designation of expert witness by a judge grants a special status to the mental heath professional. Unlike the fact witness or lay witness whose testimony is confined to knowledge usually acquired based upon what that individual has seen or heard directly, expert witnesses are permitted to offer opinions: they can testify to what they believe, interpreting the data and making use of their observations of the examinee in ways that go beyond a description of the facts. In a landmark case decided in the D. C. Circuit Court of Appeals, Jenkins v. United States (1962), the court opined that an individual is not granted the status of expert merely because of his or her professional degree. What matters is whether the potential expert witness has the appropriate background, education, skills, training, or knowledge to address the question before the court. This is determined during the voir dire process. The concepts delineated in Jenkins have been incorporated into Rule 702 of the Federal Rules of Evidence, which states: If scientific, technical, or other specialized knowledge will assist the trier of fact to

Foundations of Forensic Mental Health Assessment understand the evidence or to determine a fact in issue, a witness qualified as an expert by knowledge, skill, experience, training, or education, may testify thereto in the form of an opinion or otherwise, if (1) the testimony is based upon sufficient facts or data, (2) the testimony is the product of reliable principles and methods, and (3) the witness has applied the principles and methods reliably to the facts of the case.

The Law: Determining Admissibility of Expert Testimony to a Specific Topic Because the scope of FMHA encompasses a wide range of legal issues, the concept of a “generic” expert does not exist. A forensic mental health professional cannot possibly be an expert on every legal issue that the courts litigate. It must be demonstrated that the proposed expert possesses the specialized education, experience, knowledge, training, or skill relevant to the specific legal issue to be decided by the court. If recognized by the court as an expert, the forensic mental health professional is likely to be required to indicate the nature of the testimony to be offered, and the methodology upon which the opinions are based. This is more likely if the proposed testimony would address a topic not usually considered by the court, or involves the use of a specialized tool used by the expert as part of the FMHA. The law sets requirements that must be met in order for testimony to be admissible, “to prevent unqualified experts from testifying in the courtroom on the basis of irrelevant or inadequate evidence” (Weissman & DeBow, 2003, p. 47). Attorneys must ensure that when they retain an expert, the approach taken by this expert to FMHA is such that his or her evaluation and oral testimony would meet the legal standard for admissibility, both in substance and methodology. In Frye v. United States (1923) the court held that, in order for expert testimony to be admissible, the foundation on which it is based “must be sufficiently established to have gained general acceptance in the particular field in which it belongs” (p. 10). The Frye standard has been incorporated into federal and state jurisdictions, and served as the most influential standard for admissibility of expert testimony until 1993. In this year, the U.S. Supreme Court decided in Daubert v. Merrell Dow Pharmaceuticals (1993) that the more expansive

criteria for the admissibility of expert testimony described in the Federal Rules of Evidence superseded Frye in federal jurisdictions. The Court held that the Frye test was too restrictive, and should be replaced by a broader standard based upon whether such testimony would be likely to assist the trier of fact, and whether such testimony and the methods upon which it is based were reliable and relevant. As such, in all federal courts and in those states that have adopted the Daubert standard, testimony must be both substantively and methodologically consistent with scientific procedures. Unlike Frye jurisdictions, in which the court must only determine whether expert testimony is based on techniques that are generally accepted, judges in Daubert jurisdictions may be asked to consider a range of factors under Daubert. These may include whether the theory or technique in question can be tested; whether it has been tested; whether it has been subjected to peer review and publication; its known or potential error rate; the existence and maintenance of standards controlling its operation; and whether it has attracted widespread acceptance within a relevant scientific community. The consideration is flexible and must focus on principles and methodology rather than conclusions. Subsequently, the U.S. Supreme Court (in General Electric Co. v. Joiner, 1997) held that the trial court judge’s decision cannot be overruled by an appeals court (except in rare cases of abuse of judicial discretion). Preliminary hearings addressing the Frye or Daubert requirements are therefore critical to FMHA in any criminal or civil trial; if the legal standard is not met, the forensic expert will not be permitted to testify about any opinions that rely on the methods that did not meet the requirements. Whether practicing in a Frye or Daubert jurisdiction, it is therefore expected that forensic mental heath experts be aware of the specific evidentiary law that governs the admissibility of their testimony. Attorneys should also anticipate that experts’ testimony on an unusual or controversial topic or the use of a specialized tool may be subject to legal challenge, so the expert should be well versed in both the practice and underlying science of all parts of his or her evaluations. The Law: Setting Limits on Expert Testimony In addition to the admissibility of expert testimony, the legal system also sets limits on the subject mat-

ter of testimony. Two limitations are particularly relevant for the testimony of forensic mental health experts: reliance on third-party information as a source of data in forming opinions, and whether experts can testify to the ultimate issue. Forensic assessments differ significantly from traditional clinical evaluations in the presence of substantial external incentive to deceive the forensic examiner. To manage this challenge, experts must consider third-party information—reviewing records and interviewing collateral informants familiar with the examinee and the issue in question—to corroborate data provided by the litigant in testing and interviews. There are certain advantages provided by the use of third-party information in FMHA. Such information can (a) increase the accuracy of the findings; (b) increase the face validity of the evaluation and testimony; (c) improve communication with attorneys and judges regarding the assessment; and (d) provide information to the forensic mental health expert as to the role of deliberate distortion on the part of the examinee (Heilbrun, Warren, & Picarello, 2003; Otto, Slobogin, & Greenberg, 2007). Accordingly, attorneys should be prepared to facilitate experts’ acquisition of relevant records and interviews with third parties who can provide useful information. As attorneys are aware, third-party information is hearsay. The expert using such information relies on the indirect sources of records and interviews with collateral observers. While fact witnesses are not permitted to testify about hearsay information, the rules are somewhat different for forensic mental health experts. The Federal Rules of Evidence do allow the use and admissibility of third-party information, stating that “[i]f of a type reasonably relied upon by experts in the particular field in forming opinions or inferences upon the subject, the facts or data need not be admissible in evidence in order for the opinion or inference to be admitted” (FRE 703). Attorneys should be aware that this exception to the hearsay rule applies to the evaluations conducted by forensic experts. In some jurisdictions the law also prohibits testimony on the ultimate issue (or even the penultimate issue) (see, e.g., Tenn. Code Ann. § 39-11-501 and FRE 704(b)), while in some states and in federal jurisdictions the rules on FMHA require experts to offer opinions on the ultimate legal issue (e.g., Mich. Stat. Ann. § 28.1043, 20a(6)(c); see also United States v. Davis, 1988; United States v. Kristiansen, 1990; United States v. Salamanca, 1993).

The ultimate issue refers to the legal question that the trier of fact—the judge or jury—is charged with answering (e.g., Was the defendant insane at the time of the crime? Should the defendant be put to death?). The penultimate issue refers to the statutory definition of the legal or ultimate issue (i.e., At the time of the crime was the defendant suffering from a mental disease or defect such that he did not know what he was doing or, if he did know what he was doing, that he did not know that what he was doing was wrong? What are the aggravating and mitigating factors in this capital sentencing case?). As well, there may be policy or practice considerations in some hospitals or court clinics in the public sector that require evaluators to express an ultimate-issue conclusion in order to trigger a certain response (e.g., a hospital report that did not give an opinion that the defendant was competent to stand trial might not result in the defendant’s being transported back to court for disposition of charges). In most jurisdictions forensic experts are allowed to offer opinions on the ultimate issue (Ewing, 2003), although it should be noted that even within these jurisdictions a judge may exclude ultimate opinions if it is reasoned that (a) these opinions go beyond the expertise of the forensic clinician, and (b) such testimony represents legal conclusions that the trier of fact has been charged with deciding. There is considerable debate among the psychological and psychiatric fields as to how directly the evaluator should answer the ultimate legal question (Grisso, 2003; Heilbrun, 2001). The debate goes beyond what is legally permissible, focusing on ethical and professional considerations. For instance, such testimony potentially usurps the role of the trier of fact by adding moral- and communityvalue-laden elements to the scientific and clinical expertise required of the forensic clinician, answering questions that cannot be answered without interjecting such values (Heilbrun, 2001; Morse, 1999; Melton et al., 2007; Tillbrook, Mumley, & Grisso, 2003). Several psycholegal scholars have argued in favor of providing ultimate legal opinions (e.g., Rogers & Ewing, 2003; Rogers & Shuman, 2000), reflecting the absence of consensus in the field on this question. Whether attorneys should seek to elicit experts’ answers to the ultimate legal question remains an open question. What is clearer, however, is that they should attempt to retain experts who provide impartial, thorough, multi-sourced, legally relevant, and clearly communicated evaluations.

Foundations of Forensic Mental Health Assessment The Law Affecting the Regulation of FMHA Practice State and provincial licensing laws regulate the practice of forensic mental health professionals in a number of ways. Each jurisdiction sets its own licensing requirements, and typically limits the practice of mental health professionals under applicable licensing regulations and ethics codes to activities that fall within the boundaries of the licensee’s background and training. Licenses are largely generic and do not otherwise certify specific expertise, leaving such certification to specialty boards recognized by professional associations. While generally following these certification practices, certain jurisdictions (e.g., Massachusetts, Michigan, and Missouri) do offer limited specialty certification regarding specific forensic evaluations, and others (e.g., Alabama, Florida, and Virginia) provide periodic continuing education training that one must attend in order to be allowed to perform evaluations for the courts. One controversial issue is whether mental health professionals can conduct FMHA in jurisdictions in which the practitioner does not possess a license (see, e.g., Drogin, 1999; Shuman, Cunningham, Connell, & Reid, 2003; Tucillo, DeFilippis, Denny, & Dsurney, 2002; Yantz, Bauer, & McCaffrey, 2006). Most states and provinces offer temporary, restricted licenses to clinicians who wish to conduct assessments outside of their licensed jurisdiction. Nevertheless, both attorneys and forensic mental health professionals should be familiar with the specifics of those provisions, because different states have somewhat different requirements for obtaining temporary licenses. Behavioral and Medical Science Contributions to Best-Practice Standards The behavioral and medical sciences include assessment methods that offer forensic mental health experts reliable and valid tools for forensic assessments. These tools provide an empirical basis for the interpretation of the data offered by experts in their reports and testimony. The science surrounding these tools provides the conceptual and empirical foundations on which FMHA is based. Scientific Knowledge Providing the Theoretical Basis for FMHA Behavior is complex and multi-determined, but forensic mental health professionals work within a legal system in which the decision options are

typically dichotomous and forced-choice (e.g., sane vs. insane, competent to stand trial vs. incompetent to stand trial, liable vs. not liable). In the behavioral sciences, there is no concept of competence or incompetence, sane or insane. Not only do the terms have no clinical meaning, but they also imply that there is some line beyond which a person passes from one of these to the other. No such line exists on any behavioral measure in forensic mental health practice. The law may sometimes require that FMHA experts must say that the condition is “yes” or “no,” but forensic mental health experts should always explain to what degree they believed the person possessed the relevant abilities, and therefore provide their logic for deciding whether the person did or did not meet the legal standard. Theoretical Models for Conducting FMHA Authorities in the field recommend that (a) FMHA be guided by the appropriate legal statutes and case law that underlie the referral question, (b) objective measures (including traditional tests and forensic assessment instruments) should be used in conducting evaluations whenever possible, and (c) evaluations should incorporate data from multiple sources of information (Goldstein, 2003, 2007; Grisso, 2003; Heilbrun, 2001; Heilbrun, Marczyk, & DeMatteo, 2002; Heilbrun, Marczyk, DeMatteo, & Mack-Allen, 2007; Heilbrun, Warren, & Picarello, 2003; Melton et al., 2007; Otto et al., 2007). For over 20 years, the model communicated in Evaluating Competencies (Grisso, 1986, 2003) has provided the principal theoretical model that structures and guides FMHA. Grisso (1986) argued that most of the discontent with experts conducting FMHA resulted from (1) ignorance of the laws that drive the evaluation and the resulting irrelevance of the report and opinion; (2) intrusion into matters of the law, including opinions that address the ultimate legal question; and (3) insufficiency (reliance on inadequate information upon which to base opinions) and incredibility (speculation rather than data-based findings). To avoid these shortcomings, the model emphasizes the need to appropriately identify and understand the legal competency construct (the legal statute and case law relevant to the legal referral question) and to “operationalize” this construct so that its legal components are expressed in terms of “functional abilities” (that is, behaviors that forensic mental health professionals are qualified to evaluate). The model emphasizes the

use of empirically based data whenever possible, rather than relying solely on observations and clinical impressions. Findings of the FMHA should be interpreted in terms of the degree to which the person’s functional abilities are congruent with those required under the legal standard. Principles, Guidelines, and Maxims for FMHA Others have described principles, guidelines, and maxims for FMHA that provide theoretical contributions to a best-practice standard. Together these represent both broad theoretical components of FMHA and more specific and detailed guidelines that may be derived from them. Psycholegal scholars have generally followed two distinct approaches to considering the process of FMHA. The majority of scholars have identified a distinct form of FMHA, as defined by the legal question, and elaborated on the relevant law, ethical contours, supporting data, practice literature, and specialized tools (see, e.g., Grisso, 2003; Hess & Weiner, 1999; Melton et al., 2007; Weiner & Hess, 2005). An alternate approach begins with the assumption that all forms of FMHA share some common foundation, and then looks for the common elements of FMHA that occur across different kinds of forensic evaluations (see, e.g., Grisso, 2003; Morse, 1978). Several leading scholars have merged these approaches into foundational sources of guidance for mental health professionals conducting FMHA. Works by Simon and Gold (2004) and Melton et al. (2007) include a description of different kinds of forensic assessment as well as a discussion of common guidelines and elements. Brodsky (1991, 1999, 2004) has described a series of maxims for forensic experts focused on delivering expert testimony. Heilbrun (2001) approached this discussion by focusing exclusively on foundational principles for conducting FMHA, which have subsequently been applied to specific forms of FMHA (Heilbrun, 2003; Heilbrun, DeMatteo, & Marczyk, 2004; Heilbrun et al., 2005; Heilbrun, Marczyk, & DeMatteo, 2002). Hence, there are broad, foundational principles that guide FMHA regardless of the specific type of forensic evaluation involved. The considerable overlap in these broad principles, guidelines, and maxims allowed the authors of the book from which this chapter is derived (Heilbrun, Grisso, & Goldstein, 2009) to integrate the various attempts at describing broadly applicable aspects of FMHA

into a set of principles guiding FMHA (Table 1.1). This includes both general principles, applicable across the entire FMHA process, as well as principles specific to FMHA preparation, data collection and interpretation, and written and oral communication of results (see Heilbrun et al., 2009, for a detailed explanation of these principles). This integration appears to represent the most contemporary views of the nature of such principles serving to guide the field of FMHA. Accordingly, these principles should have value in describing the foundational aspects of FMHA for courts and attorneys as well as for mental health professionals. Professional Ethics Contributing to Best-Practice Standards Lawyers should be aware that forensic mental health professionals are guided by their respective codes of ethical conduct. For psychologists, the American Psychological Association’s Ethical Principles of Psychologists and Code of Conduct (Ethics Code) (APA, 2002a) is written to apply to all areas of psychology. Specific to FMHA, the areas in which ambiguities may occur are those created by the marked differences between the role of treating mental health professionals and that of forensic mental health experts. These differences create special questions about identifying who really is the “client” to whom the professional owes a duty, the nature of the professional relationship with the client, the nature of confidentiality, demographics of the population of “clients” in forensic cases, competence of the expert, and trust in the client (Appelbaum, 1997; Appelbaum & Gutheil, 2007; Goldstein, 2003; Greenberg & Shuman, 1997; Rosner, 2003; Weissman & DeBow, 2003). Psychology ethics committees on the national and state levels frequently employ specialized guidelines endorsed by the American Psychological Association to interpret the broader Ethics Code. The Specialty Guidelines for Forensic Psychologists (Specialty Guidelines; Committee on Ethical Guidelines for Forensic Psychologists, 1991) serve as a major source of ethics information for forensic psychologists. This document represents an aspirational model for forensic psychology practice. This means that the field recognizes that circumstances might not allow examiners to meet these higher standards in all cases, but that examiners should make every effort to strive to meet them. Like other ethical guidelines that are separate from the Ethics Code, this document is

Review the available background information and actively seek important missing elements. 18. Use relevance and reliability (validity) as guides for seeking information and selecting data sources. 19. Obtain relevant historical information. 20. Assess clinical characteristics in relevant, reliable, and valid ways. 21. Assess legally relevant behavior. 22. Ensure that conditions for evaluation are quiet, private, and distraction-free. 23. Provide appropriate notification of purpose and/or obtain appropriate authorization before beginning. 24. Determine whether the individual understands the purpose of the evaluation and the associated limits on confidentiality. Data Interpretation 25. Use third-party information in assessing response style. 26. Use testing when indicated in assessing response style. 27. Use case-specific (idiographic) evidence in assessing clinical condition, functional abilities, and causal connection. 28. Use nomothetic evidence is assessing clinical condition, functional abilities, and causal connection. 29. not an enforceable code, but rather may be used by ethics committees to interpret the Ethics Code. The American Psychological Association also endorses a number of guidelines in such specialty areas as child custody assessments (APA, 2010), evaluations in child protective matters (APA Committee on Professional Practice and Standards, 1998), and record keeping (APA, 2007). The American Psychiatric Association’s Principles of Medical Ethics with Annotation Especially Applicable to Psychiatry (American Psychiatric Association, 2001) provides ethical standards that all psychiatric practitioners are expected to follow. The American Academy of Psychiatry and the Law has authored the Ethics Guidelines for the Practice of Forensic Psychiatry (Ethics Guidelines; 2005) to provide a more specific set of ethical guidelines for forensic psychiatrists. In setting standards of conduct for mental health professionals, ethics codes help define how the “reasonably prudent professional” should practice. As such, these codes of ethics represent an important influence on the behavior of forensic experts—and are potentially valuable for attorneys to consider. Professional Practice Contributing to Best-Practice Standards The professions of psychology and psychiatry have developed a number of standards for training and specialization. Attorneys should be familiar with these standards, which are summarized in this section, because a good forensic expert will have the training, specialization, and experience needed to satisfy many of them. The substantial growth in professional organizations that focus on the intersection of the law and mental health, such as the American Psychology-Law Society, the American Board of Forensic

Psychology, and American Academy of Psychiatry and Law, has contributed greatly to the development and dissemination of forensic research, scientific knowledge, ethics, and practice expertise. Formal practice guidelines provided by professional organizations have made important contributions to establishing a standard of practice both generally (Heilbrun et al., 2008; Otto & Heilbrun, 2002; Wettstein, 2005) and related to forensic subspecialties (American Academy of Child and Adolescent Psychiatry, 1997a, 1997b, 1997c, 1998, 1999; American Academic of Psychiatry and Law, 2002; APA, 1994, 1999, 2002b; APA, 2005; Association of Family and Conciliation Courts, undated, later 2006; Mossman et al., 2007; Society for Industrial and Organizational Psychology, 2003). Thus, both psychiatry and psychology have been active in the development of aspirational descriptions of the practice of various aspects of FMHA. Another way of examining the elements that contribute to FMHA is to consider what is taught to those seeking to become experts or to those looking to expand their practice into relatively new areas. Training in FMHA occurs at a number of levels (Bersoff et al., 1997; Marczyk, DeMatteo, Kutinsky, & Heilbrun, 2007; Otto, Heilbrun, & Grisso, 1990; Rosner, 1983). At the graduate level in psychology, a number of colleges and universities now offer training in forensic psychology through master’s-level degrees (M.A. or M.S.), doctoral training (typically as a forensic concentration or minor in clinical or counseling psychology programs), or joint degrees in law ( J.D.) and psychology (Ph.D. or Psy.D.). Psychiatrists who eventually wish to be certified for forensic specialization must first acquire a specialty year of training in an accredited forensic psychiatry fellow program beyond their residency training. There are a number of forensic

Foundations of Forensic Mental Health Assessment fellowships available in the United States, and continuing education is also viewed as an integral part of continued expertise. Training in FMHA for those who have completed a doctorate in psychology usually occurs via postdoctoral fellowships (typically a single year of training, with some offering a second year; see Packer & Borum, 2003, for a sample curriculum), or as the result of participating in continuing education programs offered by an APA-approved sponsor and taught by individuals who are experts in specific areas of forensic research or practice. Finally, board certification is often touted as a marker of specialized training in forensic psychology and psychiatry. The American Board of Professional Psychology (ABPP), the oldest and most rigorous of the organizations offering board certification in psychology, confers board certification in forensic psychology on those who meet the credentialing requirements of its member board, the American Board of Forensic Psychology (ABFP). Forensic specialization in psychiatry includes board certification through the American Board of Psychiatry and Neurology (ABPN), with added qualifications for a “Certification in the Subspecialty of Forensic Psychiatry.” T O WA R D B E S T P R A C T I C E S IN FMHA This chapter has provided a summary for legal professionals regarding standards of practice for forensic psychologists and forensic psychiatrists who perform FMHA. The focus has been on “best practices” as they have evolved within the relevant professions. In that sense, these are the standards with which the professions themselves evaluate the quality of FMHA practice when providing evaluations for courts. These best-practice standards provide mental health professionals with guidance in conducting informed, appropriate, sufficient, and credible assessments in the forensic context. Legal professionals will use these professional best-practice standards when considering the appropriate standards of care for forensic practice. It would be presumptuous for mental health professionals or behavioral scientists to outline a standard of care in FMHA in general. Defining standard of care is the law’s prerogative, typically done by the court, using the professions’ standard of practice (“best practices”) to inform but not to dictate what the standard of care should be (Heilbrun et al., 2008).

As the courts consider the forensic professions’ best practices in the process of determining a standard of care, they should be aware of certain limitations and cautions when making that translation. We close by offering three of those cautions. First, the best expressions of practice standards for a profession represent a consensus of those who protect, guide, and nurture the field. Yet who those protectors are, or should be, is not entirely clear. Sometimes they are a few authorities with senior status, and occasionally they are a committee of experts identified as such by their peers. However they are constituted, they will agree on some points and disagree on others. For many points of forensic practice, a well-established consensual standard may reasonably be challenged by a minority of highly qualified forensic professionals. Consensus about a practice standard does not mean unanimity; any definition of best practices in a field is far less than an absolute and infallible dictum. When these disagreements arise in legal deliberations about standards of care, the best that can be done is to be aware of alternative viewpoints so that one can explain to others the sources of controversy. A second cautionary point about best-practice standards is their shelf life. As a dynamic ideal, standards of practice are always changing as a consequence of advances in the scientific base for the field and scholarly debate about issues of practice. Broad principles to guide the assessment process are likely to change less rapidly than, for example, recommendations regarding specific assessment tools. A published standard of practice, therefore, is always decaying in relation to the dynamic evolution of the field. Courts’ use of practice standards in the context of standards of care needs to take this into consideration. Law tends to adhere to precedent, while forensic best practices are malleable in relation to the evolution of science and clinical methods. To some extent, the law’s standards of care also must evolve with the professions’ changing best-practice capacities. A third caution about best-practice standards is difficulty in applying them to the diversity of cases, types of evaluations, and circumstances encountered in FMHA. Mental health professionals conduct FMHA across a variety of settings and contexts, each coming with its own set of facts, obstacles, and opportunities. Further, legal definitions of the forensic questions that these experts address may differ from one state to another, and judicial

demands may differ between courts within a given state. Developing a single set of best practices for two different professions in a nation with 51 sets of laws is a daunting task. The success with which this can be done depends largely on recognizing how jurisdictions and professions may differ, then crafting the standard in a manner that accommodates to that diversity rather than offering a rigid set of rules. Therefore, the law will be challenged when attempting to apply a single, nationally referenced standard of practice to a standard of care within a particular jurisdiction, or a particular subtype of FMHA. The remaining chapters of this book will incorporate the broad principles and practices discussed here, applying them more specifically to a variety of legal questions. This combination of broad principles in application to specific legal questions, seeking best practice whenever possible, should help attorneys and courts use these evaluations most effectively.
