The Georgia Composite Medical Board (GCMB) held its regular meeting on June 7-8, 2012 at 2 Peachtree Street, NW, 36th Floor, Atlanta, Georgia 30303, to consider Medical Board matters. Board Members in attendance on Thursday, June 7, 2012: Charles White, DO, Chairperson William Butler, MD, Vice Chairperson John S. Antalis, MD Eddie R. Cheeks MD Alexander S. Gross, MD Kathy Kemle, PA, Ex-Officio Board Member Rhonda Kunes, Consumer Member Marion O‟Neil Lee, MD David W. Retterbush, MD William Sightler, DO Roland S. Summers, MD Wendy Troyer, MD Richard Weil, MD Board Members absent on Thurs day, June 7, 2012: Gilbert Chandler, MD Alice House, MD Kathy Kinlaw, Consumer Member Representatives from the Attorney General’s Office: Wylencia Hood Monroe, Senior Assistant Attorney General Amelia Baker, Senior Assistant Attorney General Dr. White called the meeting to order at 8:00 a.m. AGENDA Dr. Retterbush made a motion, seconded by Dr. Weil, to approve the agenda of the June 7-8, 2012 GCMB meeting. The motion carried unanimously. MINUTES Dr. Gross made a motion, seconded by Dr. Butler, to approve the minutes of the May 3-4, 2012 Board meeting. The motion carried unanimously. Dr. Weil made a motion, seconded by Dr. Summers, to approve the minutes of the May 8, 2012 Board teleconference. The motion carried unanimously. EXECUTIVE DIRECTOR’S REPORT Ms. Hughes presented the following report to the Board:

1.

The Board directed Rajesh Patel, MD to the Rules and Laws of Georgia and the Medical staff rules at his individual medical facility for the answers to his questions.

2.

In response to the Drs. Carolos Giron and Karen Bramblett regarding CRNA‟s administering epidural steroid injections, the Board determined that if the physician is present, ordering the medication, evaluating the patient, and directing the CRNA, the CRNA can perform specific injections.

3.

In response to Ms. Jessica Peterson regarding a dog being present in the physician‟s office – although there is no rule or law preventing this, pets should not be present in physician offices due to hygiene reasons.

4.

In response to Ms. Susan Oladeji regarding a dietitian taking orders from a physician, the Board requested additional information.

5.

In response to Mr. Gary Bell, a physician is required to update the hospital privileges section of the Physician Profile on the Medical Board‟s website whenever he/she chooses to no longer admit patients to a particular hospital.

6.

In response to Mr. Ted Arkfeld, a physician should comply with the By-Laws of a hospital for a timeframe for completing patient/chart notes after a patient encounter, which is usually within 24 hours.

7.

Dr. Summers made a motion, seconded by Dr. Butler, to accept the Position Statement on the “Unacceptability of Concurrent Respiratory Therapy.” The motion carried unanimously.

8.

In response to Dorothy Davis regarding Physician Assistants (PA) doing house calls, the Board determined that the PA must practice where the physician practices – if the physician is clinically active doing house calls, then the PA can perform house calls. Ms. Kemle, PA Ex-Officio member, agreed to work with Ms. Davis.

9.

In response to David Dziura, the Medical Board can only license physicians to practice in Georgia, not corporations. The corporate practice of medicine has not been defined by the state legislature.

10.

In response to Jane Santucci, physician should not compensate patients for referrals.

11.

In response to Lisa Banker, monitoring is required as part of the standard of care for opioid prescribing. However, a physician can document any exclusions or hardships that would prevent the monitoring from being done in a specific time frame.

Dr. Lee made a motion, seconded by Dr. Cheeks, to draft a resolution to not support national licensure for physicians and nurses.

The Board accepted the following as information: 13.

The USA Today article entitled “Gregory House, MD: RIP.” The end of a TV series about a brilliant but „disruptive‟ doctor provides lessons for the real world.

14.

Article entitled “New Mexico law requires medical board reporting for terminated employees.”

15.

Educational Commission for Foreign Medical Graduates (ECFMG) introduces a new E- newsletter for International Medical Schools.

16.

Article from the Journal of Opioid Management entitled “Physician Survey Examining the impact of an Educational Tool for Responsible Opioid Prescribing.”

17.

Article from Rx News entitled “How Florida Brothers‟ „Pill Mill‟ Operation Fueled Painkiller Abuse Epidemic.”

18.

Reopen Case # 20121299 and invite for an interview.

19.

A physician asked if he can self-prescribe and was referred to the Rules and Laws.

CLOSED SESSION Dr. Gross made a motion, seconded by Dr. Butler, to go into closed session. The motion carried unanimously. Dr. White declared the Board would then be in Open Session. APPEARANCES BEFORE THE BOARD Mark Beirne, MD requested an appearance before the Board for denial of physician licensure. Dr. Beirne was represented by his attorney, Fran Cullen. Drs. Steve Lynn and Paul Earley were present as advocates for Dr. Beirne. Dr. Beirne presented oral arguments. The Board members asked questions. Steven Prior, MD requested an appearance before the Board with the request to remove his Public Board Order from the website. Dr. Prior presented oral arguments. The Board members asked questions. CLOSED SESSION

Dr. Gross made a motion, seconded by Dr. Retterbush, to go into closed session. The motion carried unanimously. Dr. White declared the Board would then be in Open Session. OPEN SESSION Dr. Butler made a motion, seconded by Dr. Weil, to license Dr. Beirne with terms and conditions. The motion carried unanimously. Dr. Gross made a motion, seconded by Dr. Summers, to table the matter on Dr. Prior for additional information. CLOSED SESSION Dr. Butler made a motion, seconded by Dr. Retterbush, to adjourn to conduct investigative interviews. The motion carried unanimously. Dr. White then declared that the meeting would reconvene upon completion of the investigative interviews. RECONVENED Dr. White declared the meeting in open session at 3:30 p.m. Dr. Weil made a motion, seconded by Dr. Cheeks, to accept the Consent Order for M.J. The motion carried unanimously. ADJOURN Dr. Butler made a motion, seconded by Ms. Gross, to adjourn at 3:55 p.m. and reconvene Friday morning. The motion carried unanimously. ACUPUNCTURE ADVISORY COMMITTEE Dr. Gross presented the report of the Acupuncture Advisory Committee. Dr. Summers seconded the Committee‟s motion and it carried unanimously. The Board reviewed the list of limited licensees and their supervisors. PHYSICIAN LICENSING AND PROFILES ADVISORY COMMITTEE Dr. Gross presented the report of the Physician Licensing and Profiles Advisory Committee. Dr. Summers seconded the Committee‟s motion and it carried unanimously. The Board took the following actions: 1.

The motion carried unanimously. Refer Rule 360-15-.01 “Requirements for Physicians” to the Attorney General‟s Office for review and approval before posting. Post for public comments Rule 360-13-.01 “Requirements for Board Certification,” Rule 360-13-.12 “Practice of Respiratory Care Without Certification Prohibited; Exceptions,” and Rule 360-2-.14 “Requirements for Approval of International Medical Schools”. Rules Hearing will be scheduled for July 12, 2012. FOREIGN MEDICAL SCHOOL COMMITTEE Dr. Cheeks made a motion, seconded by Dr. Butler, to accept the following report. The motion carried unanimously. The Board reviewed some of the proposed items for the application and asked the staff to send out the California Self- Assessment Form for review. There being no further business to conduct, Dr. Butler moved that the June 7-8, 2012 GCMB meeting be adjourned at 11:04 am. Dr. Retterbush seconded and it carried unanimously.
