Postponement of Motion to Dismiss; Ongoing Settlement Negotiations Edina High School Young Conservatives Club, et al. v. Edina School District, et al. Case No. 17-CV-05380 (MJD/KMM)
Dear Judge Davis: After speaking with chambers this morning and having received permission to file this letter ECF, we wish to inform you that at the present time the parties are in settlement negotiations concerning the above matter. As you may know, the Defendants have moved to dismiss the Plaintiffs underlying Complaint. The hearing is scheduled for March 22, 2018. The Defendants have also filed their supporting memorandum of law. In light of the likely settlement of the matter, the parties have agreed to postpone the scheduled hearing indefinitely. Likewise, the Plaintiffs response to the motion to dismiss would also be delayed indefinitely. The indefiniteness is necessary because although counsel may have reached an agreement regarding the terms, wording, and conditions of resolving the claims, the matter must still be considered and approved by the Edina School District Board. Therefore, we respectfully request this Court to postpone both the hearing to dismiss and the Plaintiffs response to the motion indefinitely pending the outcome of the ongoing settlement negotiations and approval of the Edina School Board.
