National Content Reporting Guidelines On May 26th, 2017, the Ministry of Economy (SE) published in the Mexican Official Gazette the Accord that provides Contractors the guidelines to submit National Content Information for activities of the Hydrocarbon Industry (“The Accord”). Although the Accord does not include any interpretation rules or criteria of the Methodology to compute the National Content of Contracts, it does provide the framework of the reporting obligations of the Contractors. Below is a summary of the most relevant reporting obligations and other provisions included in the Accord:  • Within 30 business days of the signature of Contract with the National Hydrocarbons Commission, the Operator must designate a domicile in Mexico for notifications related to National Content. Likewise the Operator will be required to assign a Legal Representative for National Content matters and will be allowed to designate authorized liaisons. • All National Content information must be submitted annually in Spanish during the month of April. Notwithstanding, for Contracts which had reporting obligations during 2015 and/or 2016, National Content information for those periods should be reported no later than August 31, 2017. • The Accord includes the official form and seven attachments that must be completed, signed and submitted by the Contractor in order to comply with National Content obligations. • In order to support the National Content computation, the Contractor will be required to supply the Ministry of Economy all affidavits issued under oath by Domestic Suppliers as part of the National Content Official Form and its Appendix’s. • National Content data reported to the Ministry of Economy must be kept by the Contractor for at least 18 months after the filing. This recordkeeping period can be interrupted during audit and validation procedures initiated by the Ministry of Economy. • The Ministry of Economy will be authorized to request National Content information at any time, and may request additional information for reports already submitted by the Contractors. The term to respond to official request will range between 5 and 30 working days depending on the timing of the request. • Due dates may be extended on a onetime basis, provided the Contactor requests the authorization to the Ministry of Economy.
