Breakout Definition  Scope: Contracting Solutions for Public Private Partnering  Objectives:  Identify benefits of PPP and the things to protect in order to maintain industrial base capability to support the Warfighter.  Identify barriers to effective PPP  Problem Statement: The infrastructure and capability of the industrial base to support the Warfighter in a budgetconstrained environment is at risk.

Opportunity or Problem Statement: Current statutory law mandates consideration of PPP within the life cycle of DoD programs. A lack of consistent PPP knowledge within the DoD and Industry has hampered the utilization of Partnering.

Business Impact: In order to comply with current statutes, an increased understanding of overall PPP concepts, requirements, benefits, and statutory authority must be addressed to enable PPP to be considered during the establishment and execution of DoD acquisition and sustainment initiatives.

Goal Statement / Objectives: To provide more cost effective, timely, and reliable support to the Warfighter.  Identify target audience (legal, contracting, BD, financial, program management, etc.)  Identify training content (statutes, implementation processes, methodology, metrics, etc.) Develop training modules and standards 3 phases, 1: OSD guidance per Regulations, Statutes, 2: Short Term PPP training, within 6 months, #3 Multiple in depth training courses within DAU.

Scope: Determine intent of current regulation, Publish OSD opinion to establish a common direction Determine what training currently exists Evaluate content of current training Determine target audience (SPO, Depot, Industry, etc..) Incorporate DoD and Industry’s perspectives, lessons learned, best practices, etc. Update/Create training defining the law and the concepts, requirements & benefits of PPP.

Opportunity or Problem Statement: Language used to implement 10USC-2474(2563) in partnering agreements/contracts and other documents is not consistently implemented across DOD Agencies. Lack of templates and standard public-private partnership (PPP) documents creates confusion across DOD and industry when creating PPP.

Business Impact: Consistent implementation of contract and contract-related clauses/provisions throughout DOD. Particular focus on indemnification/liability and consistency across DOD. Improved PPP implementation and common understanding of procedures.

Goal Statement / Objectives: Develop standardized documents and liability and indemnification language for PPP documents and agreements. Educate & implement standardized interpretation & application across DOD.

Phase 1. Standardize contract indemnification and liability language across all PPP agreements. Language will cover statutory mandate and allow for alternative language for specific situations . Phase 2. Standard templates for PPP partnering agreements and implementing documents.
