Terms & conditions for appointment on contract basis in Indo-Tibetan Border Police Froce for imparting rotational training to ITBPF officers and personnel fighting against Left Wing Extremist violence 1.

Term of engagement:

a)

The appointment will be purely on contractual basis initially for fixed period of two years which may be extendable upto a maximum period of one more year i.e. 3rd year with effect from the date of joining. Thereafter, the contract will lapse automatically. However, the appointment can be terminated at any time by giving one month’s notice (on either side) without assigning any reason by paying one month’s salary.

b)

During the period of engagement, he will work under the overall administrative control of the Commanding Officer of the said Unit/Institute. He will execute all the administrative orders either written or verbal passed by any superior officer so designated followed by maintaining Force decorum. The appointment carries with it the liability to serve in any institution imparting training on Counter Insurgency and Jungle warfare and in the units deployed in fighting against naxalism in India.

c)

Maximum age limit for contractual appointment would be 56 years and on attaining the age of 56 years of age, the contractual appointment shall stand terminated.

d)

The candidates should not have been convicted by any court of law for offences involving moral turpitude.

Charter of duties:

a)

The Charter of duties of officer/personnel placed at CIJW School, Mahidanda will be to train personnel in CIJW and advise the OC, CIJW School on training matters. The instructors hired will impart specifically CIJW Training wherein they will carry out refresher training and preinduction training to Coys prior to deployment in ANO areas. He shall perform the duties assigned to the post. The Competent Authority reserves the right to assign any other duty as and when required and as deemed fit.

Miscellaneous:

a)

Only consolidated salary will be admissible, no dearness allowance and other allowances as are admissible to the Govt. Servant shall be admissible.

b)

The Ex-Servicemen engaged on contractual basis shall wear the uniform as worn by any regular employee in ITBPF followed by maintain exemplary turn out. A lump sum amount of ₹1367/- to be paid annually as a grant for uniform to all contractually engaged retired Army Personnel for the period of contract.

c)

Expenditure on travel performed by the contractually engaged personnel on official account- certified by the controlling officer- shall be borne by the respective training centre/ANO unit within the budget grant allotted to them.

d)

The class of travel, compensation towards DA etc. shall be that of an equivalent rank in the ITBPF. However, LTC/ railway warrant cannot be granted to such engaged personnel as retired personnel are not eligible for the same.

Ex-servicemen (and their dependents) are covered under the Exservicemen Contributory Health Scheme of Ministry of Defence. However, when posted in the Training Centre/ Unit of ITBPF, they shall have access to the medical treatment facilities as existing for the serving ITBPF personnel.

f)

The engaged personnel shall also be granted ex-gratia compensation (on its occurrence) as eligible to other ITBPF personnel. As regards disability sustained during the engagement period, while disability pension cannot be paid/granted, a separate mechanism for calculation of the compensation (based on the NPV of the cash outgo in respect of an equivalent ITBPF personnel) may be considered by R&W Directorate, MHA in consultation with ITBP.

g)

The candidate appointed shall have no claim or preference for regular employment or promotion in the department.

h)

He shall not be entitled to the benefits of pension, Gratuity, GPF, Regimental Fund etc., as admissible to regular employees of the ITB Police.

i)

He shall be on the whole time appointment of the organization and shall not accept any other appointment paid or otherwise of any kind during the period of contract.

j)

He shall be entitled for casual leave at par with the other regular employees, serving in CIJW School of the Force and units deployed on Anti-naxal-operations, with the approval of the competent authority in addition to the Government holidays. No other leave/vacation with pay will be admissible. However, in special circumstances leave without pay could be granted upto the discretion of the competent authority.

k)

In case of any misconduct or omission during his tenure, the contract will be terminated by the Competent Authority without any further notice.

l)

Other conditions of contract will be governed by the relevant rules and orders issued from time to time.

m)

If any declaration or information given by him proves to be false or if he is found to have wilfully suppressed any material information, he will be liable to be removed from service and any such other action as the Govt may deem necessary.

The Director General, ITBP would have the right to terminate this contract at any time after giving one month’s notice without assigning any reason.

o)

No travelling or other allowances will be paid to the applicants for attending the selections process or for joining the post offered.

p)

The contractually engaged shall be allowed to dine in the ITBPF Mess and be provided Messing facility at par with other regular employees of ITBPF holding similar rank and status on payment system.

6.

His appointment will be further subject to the following conditions:-

a)

The offer of appointment shall be further subject to verifications of character and antecedents.

b)

The selected contractual appointee would be subject to the ITBPF Act1992 and Rules-1994, during the terms of their engagement. In case the contractually engaged is found responsible for any act of omission or commission in regard to any indiscipline, they will be treated as likewise ITBPF employees and ITBPF Rules will be applicable.

c)

The physical fitness from the competent medical board for which he will be sent to the designated Medical Authority after his joining and in case any deformity is noticed and declared medically unfit, his appointment will stand null & void.

d)

Submission of declaration regarding marital status in the prescribed proforma.

e)

Taking of an Oath of allegiance faithfulness to the constitution of India (or making of a solemn affirmation to the effect) in the prescribed form.

f)

Production of the following original certificates:(i)

Discharge book/certificate from Army (Infantry) duly indicating date of birth, date of appointment, rank in which appointed and to which retired, pay drawn at the time of retirement, pension authorized/being drawn.

(ii)

Courses/training under taken during employment with Indian Army (Infantry division).

(iii)

Specific achievement on Counter Insurgency and Jungle Warfare. Experience earned as Instructor in training Army Training Institutions (especially on Counter Insurgency and Jungle warfare).

(iv)

Last unit served with in Army with complete, address, name and designation of Commanding Officer.
