Section I. Introduction Prior to the 2015 Legislative Regular Session, AARP Florida advised legislators that it would publish this final report on voting records for bills identified by AARP as having special significance for our members and Florida’s older residents. When a bill was selected for vote recording and was placed on an agenda to be heard, AARP Florida notified legislators by email (see p. 6 for an example). The email stated that AARP would track the bill and report the votes on that bill, or any successor bill through the entire legislative process. AARP also provided updates on the status of the bill to its volunteers and stakeholders through the AARP blog and AARP Twitter accounts. Section I provides the communication to legislators on vote recording and a complete list of all Florida legislators and their parties, districts, and county legislative delegations. Section II provides a summary of all the bills AARP Florida selected for the final voting record report. The summaries identify the pages where readers may review the voting records for each bill. The legend below provides instructions on how to navigate the voting record tables located in Section III. Visit www.aarp.org/flvotingrecord2015 to view the electronic version of this 2015 report. The information and votes in the 2015 AARP Florida voting record reflect Florida Senate and House of Representative roll call votes as of June 29, 2015.

Communication to Legislators on Voting Record Report January 21, 2015
Dear Senator, AARP strongly believes voters should be informed on issues affecting older Floridians. With this in mind, and in response to requests from our members and from Florida legislators sitting on both sides of the aisle, AARP will identify bills of particular interest to AARP’s members and tell them how legislators vote on those bills during each legislative step. AARP will provide legislators notice of the bills selected for this reporting. AARP plans to publish a final voting record report at the conclusion of the 2015 Legislative Session. Included is a link to the voting record report which was published at the conclusion of the 2014 Session: www.aarp.org/flvotingrecord2014. In order to increase understanding of the legislation and lawmakers’ views on bills, AARP will encourage its readers to contact state legislators directly to learn more. Section II. Summaries of Bills Selected for Vote Recording
Budget General Appropriations Act for Fiscal Year 2015-2016: Failure of the two Chambers to agree on the 2015-2016 state budget during the Regular Session forced Special Session 2015A. The legislation was refiled as SB 2500A General Appropriations Act 2015 by Senator Lee; SB 2502A Implementing 2015-2016 General Appropriations Act by Senator Lee; SB 2508A Medicaid by Senator Lee; SB 2516A Implementation of the Water and Land Conservation Constitutional Amendment by Senator Lee, PASSED. The bills are now Chapter No. 2015-232/Chapter No. 2015-222/ Chapter No. 2015-225/Chapter No. 2015-229, Laws of Florida, effective July 1, 2015. The companion bills were HB 1A General Appropriations Act by Representative Corcoran; HB 3A Implementing the 2015-2016 General Appropriations Act by Representative Corcoran; HB 9A Medicaid by Representative Hudson; and HB 15A Implementation of Water and Land Conservation Constitutional Amendment by Representative Boyd. The Florida Legislature passed a $78.6 billion budget for Florida’s Fiscal Year 2015-2016. SB 2500 General Appropriations Act 2015 by Senate Appropriations Committee; SB 2502 Implementing 20152016 General Appropriations Act by Senate Appropriations Committee; and SB 2512 Medicaid by Senate Appropriations Committee, FAILED. The companion bills were HB 5001 General Appropriations Act by House Appropriations Committee; HB 5003 Implementing the 2015-2016 General Appropriations Act by House Appropriations Committee; and HB 5101 Medicaid by Representative Hudson. Some impacts from the appropriations act include: •
Statewide Medicaid Managed Care Long Term Care (SMMC LTC): The program is designed to provide home-andcommunity-based services to indigent Medicaid recipients requiring nursing facility level of care and who are 65 years of age or older or who are age 18 or older and disabled. The budget allocates an increase of $3,240,655 to serve (with home-and-communitybased services) approximately 212 wait-listed seniors.

Assistive Care Services (ACS): The budget maintains FY 2014-15 funding rate of $13,435,904. ACS is a Medicaid-based, state administered program that provides care for eligible low-income residents residing in a qualified assisted living facility or adult family-care home. These

services are for residents who demonstrate functional limitations. ACS includes, but is not limited to, assistance with activities of daily living, medication administration, and health support. •
Program for All-Inclusive Care for the Elderly (PACE): PACE provides home-and-community-based services for individuals who would otherwise qualify for Medicaid nursing home placement. The budget provides an increase of $3,024,239 in funding to serve approximately 156 additional individuals (slots) in Palm Beach County and an increase of $975,570 to serve approximately 50 additional individuals in Pinellas County. The Governor vetoed the funding for Pinellas County.

Alzheimer’s Disease Initiative (ADI): Alzheimer’s respite care services will receive an increase of $1,700,000 in General Revenue funding to serve approximately 167 wait-listed individuals. Also, $650,000 of funding for ADI will go towards the following projects: Alzheimer’s Project, Inc. and Alzheimer’s Community Care Association.

Aging and Disability Resource Centers (ADRCs): The budget maintains FY 2014-15 funding of $1,300,000 in nonrecurring funds. These funds will go to the 11 ADRCs, which assist older adults with information, program eligibility, and intake and assessment under the Statewide Medicaid Managed Care Long Term Care program.

Community Care for the Elderly (CCE): The budget provides Community Care for the Elderly (CCE), a non-Medicaid program, an increase of $2,000,000 General Revenue funding to serve approximately 300 more individuals. However, there is a waitlist for the program numbering in the thousands. CCE provides home-and-community-based services (HCBS) to seniors aged 60+ who may be at risk of nursing home placement. CCE provides services such as adult day care, case management, home delivered meals, and home nursing.

Senior Legal Hotline: The budget includes an increase of $250,000 from General Revenue to operate a statewide senior legal helpline.

Public Guardianship: The budget maintains the FY 2014-15 funding rate of $3,000,000 from General Revenue to operate the statewide Public Guardianship program. This resource may also fund local public guardianship offices. The budget also maintained FY 2014-15 funding of $750,000 nonrecurring funds to Lutheran Services Florida, which would have provided guardianship services to the indigent statewide. The Governor vetoed the funding for Lutheran Services Florida.

Affordable Housing: The budget appropriates $175,000,000, including $70,000,000 to fund construction or rehabilitation of rental units for older adults, the homeless, and persons with developmental disabilities through the State Apartment Incentive Loan (SAIL) program. The budget also includes $105,000,000 for the State Housing Initiatives Partnership (SHIP) program. SHIP must use a minimum of 20 percent of the funds to serve persons with special needs. SHIP provides funds to local governments to incentivize partnerships that produce and preserve affordable homeownership and multifamily housing. SHIP may use funds for emergency repairs, new construction and rehabilitations. See Voting Record for SB 2500A p.21; SB 2502A p.23; SB 2508A p.25; 2516A p.82
Health and Supportive Services Assisted Living Facilities (ALFs): CS/CS/HB 1001, by Representative Ahern, PASSED. The companion bill was CS/CS/SB 382 by Senator Sobel. The legislation is now Chapter No. 2015-126, Laws of Florida, effective on July 1, 2015. AARP supported the legislation. In 2011, the Miami Herald published an expose, “Neglected to Death”, highlighting abuses occurring in ALFs and shortcomings in the state regulatory response to such cases. In response to this expose, Senator Sobel championed legislation for 4+ years. However, the legislative Chambers were unable to come to agreement on a hybrid bill until this legislative session. The legislation: • Establishes heightened consumer protections for those in ALFs; strengthens the enforcement of current regulations; mandates additional training for ALF staff; requires additional inspections for facilities cited for significant violations; and requires the Agency for Health Care Administration to add certain content to its website to help consumers select an ALF; etc. See Voting Record for CS/CS/HB 1001 p.33; CS/CS/SB 382 p.35

State Ombudsman Program: CS/SB 7018, by Senator Sobel, PASSED. The companion bill was CS/CS/HB 293 by Representative Roberson. The legislation is now Chapter No. 2015-31, Laws of Florida, effective on July 1, 2015. AARP supported the legislation. The legislation: • Restructures the State Long-Term Care Ombudsman Program, regulated by the Department of Elder Affairs (DOEA), and conforms that program to requirements in the federal Older Americans Act. • Requires a Long-Term Care Ombudsman to be state certified, clarifies that an owner or provider of a longterm care facility can’t be an ombudsman and requires background screening for an ombudsman. • Provides and clarifies procedures for complaint reports/resolutions and establishes a notification process in the event of imminent danger to the health, safety, welfare or rights of a facility’s residents. • Establishes state districts, which may have one or more local councils. AARP drove the successful amendatory effort to require at least quarterly public meetings by each state district. See Voting Record for CS/SB 7018 p.36; CS/CS/HB 293 p.38 Patient Admission Status Notification: CS/HB 309, by Representative Harrison, PASSED. The companion bill was CS/SB 786 by Senator Gaetz. The legislation is now Chapter No. 2015-109, Laws of Florida, effective on July 1, 2015. AARP supported the legislation. Patients on "observation status" may stay in a hospital for a period of time and receive care that may be indistinguishable to them from inpatient care. However, Medicare requires a three-day "inpatient" hospital stay, rather than a stay on "observation status," as a precondition for Medicare coverage of post-discharge rehabilitation services, particularly for skilled nursing facility (SNF) services. Time spent in observation status does not count toward that three-day stay requirement and, prior to this legislation, patients and nursing homes were left in doubt as to the applicability of Medicare rehabilitation coverage. The legislation: • Requires hospitals to notify patients in their discharge papers if the hospitalization was classified as an observation stay or as an inpatient admission. As a result, nursing homes and Medicare patients will have notice about who will be responsible for rehabilitation care at the outset of rehab services. Advanced Registered Nurse Practitioners: CS/CS/HB 335 by Representative Plasencia, PASSED. The companion bill was CS/SB 476 by Senator Grimsley. The legislation is now Chapter No. 2015-111, Laws of Florida, effective on July 1, 2015. AARP supported the legislation. The legislation: • Expands the “scope of practice” for psychiatric advanced registered nurse practitioners (ARNP). • Revises the definition of “psychiatric nurse” and authorizes a psychiatric nurse to examine a psychiatric patient, to admit the patient to a receiving facility and to approve the patient’s discharge, provided the nurse operates under a physician’s protocol. See Voting Record for CS/CS/HB 335 p.42; CS/SB 476 p.44 CS/CS/CS/SB 532, by Senator Grimsley, FAILED. AARP supported the legislation. The legislation would have: • Authorized ARNPs, under the framework of established protocols with physicians, to order any medication for administration to a patient in a hospital, ambulatory surgical center, or mobile surgical facility. • Provided authority for a supervisory physician to authorize a physician assistant (PA) or an ARNP to order controlled substances for administration to a patient in a hospital, ambulatory surgical center, or mobile surgical facility. See Voting Record for CS/CS/CS/SB 532 p.45 CS/CS/HB 281 by Representative Pigman, FAILED. The companion bill was CS/CS/CS/SB 614 by Senator Grimsley. AARP supported this legislation. The legislation would have: • Authorized PAs and ARNPs to prescribe controlled substances under current supervisory standards for PAs and protocols for ARNPs. • Prohibited PAs and ARNPs from prescribing controlled substances in pain-management clinics. as CS/CS/SB 2A by Senator Bean and FAILED. AARP monitored the legislation. Under the Patient Protection and Affordable Care Act (PPACA), States have an option to expand Medicaid coverage benefits to nonelderly adults with incomes below 138 percent of the federal poverty level (FPL). This legislation would have: • Authorized the Agency for Health Care Administration to seek federal approval to implement the Florida Health Insurance Affordability Exchange Program (FHIX). • Drawn down federal match dollars from PPACA to extend access to healthcare insurance coverage to approximately 800,000 low-income, working Floridians through a private option plan. • Required enrollees to provide proof of employment, on-the-job training, job placement activities, or pursuit of education opportunities. An exemption would have applied to individuals who are disabled or who are caregivers of persons with disabilities. • Prohibited AHCA from implementing a federal waiver substantially different from the provisions of the state statute. • Charged participants for inappropriate use of emergency room visits, assessed mandatory monthly premiums based on their modified gross income, and suspended participants’ coverage for a minimum of 6-months if full premium payments were not received after a 30-day grace period. The companion bill was CS/HB 545 by Representative Cummings and Representative Jones. AARP supported this legislation. The legislation would have: • Allowed ARNPs registered with the Board of Nursing to practice advanced or specialized nursing without physician supervision or without physician protocol. Health Care: CS/SB 784 by Senator Gaetz, FAILED. The companion bill, HB 863, by Representative Harrison, never had a committee hearing. AARP supported this legislation. The legislation would have: • Created the “Right Medicine, Right Time Act” and established the Clinical Practices Review Commission within the Department of Health to review prior authorization, step therapy, and other protocols submitted by health plans to determine if the limitations were supported by sufficient clinical

Attorney Act that allows family caregivers (specifically an individual’s parent, spouse, child or grandchild) to continue to legally serve as agents under powers-ofattorney, unless suspended or unless terminated by courts. • Gives an alleged incapacitated person and his or her attorney at least 24-hours advance notice of a hearing to appoint an emergency temporary guardian. • Requires courts to explain why a particular guardian is chosen for a ward if the court does not use a rotation system to select guardians. • Allows family members of a ward to petition a court for a hearing if a guardian denies visitation between the ward and the ward’s family. Dental Care: CS/CS/SB 606 by Senator Gaetz, FAILED. The companion bill was CS/HB 657 by Representative Cummings. AARP supported this legislation. The legislation would have: • Created joint state and local dental care access accounts to incentivize Florida-licensed dentists to serve underinsured or uninsured patients in areas of the state where there are shortages of dental health professionals. See Voting Record for CS/CS/SB 606 p.52; CS/HB 657 p.53 Palliative Care: SB 438 by Senator Sobel, FAILED. The companion bill, HB 511, by Representative Plasencia, never had a committee hearing. AARP supported this legislation. The legislation would have: • Established the Palliative Care Consumer and Professional Information and Education Program within the Department of Health (DOH). • Directed the DOH to include palliative care information and links on its website. • Created an 11 member Florida Palliative Care and Quality of Life Interdisciplinary Task Force within DOH to consult with and advise the DOH on matters relating to the establishment, maintenance, operation, and outcome evaluation of palliative care initiatives in the state. Consumer Protections Guardianship Proceedings: CS/CS/CS/HB 5, by Representatives Passidomo and Rodriguez, J., PASSED. The legislation is now Chapter No. 2015-83, Laws of Florida, effective July 1, 2015. The companion bill was CS/CS/SB 318, by Senator Diaz de la Portilla. AARP supported this legislation. In December 2014, the “Sarasota Herald-Tribune” ran a special series "The Kindness of Strangers: Inside Elder Guardianship in Florida," which prompted a number of bills re: the Guardianship system. This legislation: • Implements a provision of the Uniform Power of
CS/SB 1226, by Senator Detert, FAILED. The companion bill was CS/HB 1225, by Representative Ahern. AARP monitored this legislation. The legislation would have: • Established regulation and supervision of professional guardians by the Department of Elder Affairs. See Voting Record for CS/SB 1226 p.57; CS/HB 1225 p.57 Public Service Commission/Public Utilities: CS/HB 7109, by the House Energy & Utilities Subcommittee, PASSED. The legislation is now Chapter No. 2015-129, Laws of Florida, effective July 1, 2015. The companion bill was CS/CS/CS/SB 288, by Senator Latvala, J. HB 219 by Representative Peters, was the companion bill to CS/CS/CS/ SB 288. AARP supported this legislation. • This legislation limits future PSC members to three consecutive four-year terms; requires annual ethics training for commissioners; requires utilities to notify customers of the best available rates and prevents utilities from using extended billing cycles to increase rates. • A new financing mechanism, referred to as securitization, will allow Duke to cut interest costs on plant decommissioning from the current 7% to 2.6%, saving customers about $600 million. See Voting Record for CS/HB 7109 p.58; CS/CS/CS/SB 288 p.60 SB 230, by Senator Dean, FAILED. The companion bill, HB 81, by Representative Dudley, never had a committee hearing. AARP supported this legislation. The legislation would have: • Required any proposed change in a public utility’s billing cycle to be approved by the Florida Public Service Commission. • Prohibited the extension of a billing cycle beyond a specified period.

AARP supported this legislation. • This legislation provides individuals and businesses greater protections against identity theft, enables individuals to more easily identify when identity theft has occurred and removes barriers to restoring their identities and credit. • This legislation provides additional forms of restitution to victims. AARP supported this legislation. • This legislation allows a grandparent or greatgrandparent of a minor child whose parents are deceased, missing, or in a persistent vegetative state to petition the court for visitation. • A grandparent or great-grandparent may also petition for visitation if there are two parents, one of whom is

deceased, missing, or in a persistent vegetative state and the other has been convicted of a felony or certain violent crimes. See Voting Record for CS/CS/HB 149 p.67; CS/SB 368 p.69 Florida Right to Try Act / Experimental Treatments for Terminal Conditions: CS/CS/HB 269, by Representative Pilon, PASSED. The legislation is now Chapter No. 2015-107, Laws of Florida, effective July 1, 2015. The companion bill was CS/CS/SB 1052, by Senator Brandes. AARP supported this legislation. The Food and Drug Administration (FDA) has regulatory authority over what drugs are marketed and sold within the United States. Investigational or experimental drugs are new drugs which have not been approved by the FDA, but are being tested for safety and effectiveness. • This legislation creates the “Right to Try Act,” which establishes the framework under which an eligible terminally ill patient may gain access, after phase one clinical trials, to investigational drugs, biological products, and devices from the manufacturer. • Requires certain information and attestations in a written informed consent document, which must be signed by the patient or the patient's parent, guardian, or health care surrogate and which must be provided to the manufacturer. See Voting Record for CS/CS/HB 269 p.70; CS/CS/SB 1052 p.72 Appointment of an Ad Litem: CS/CS/CS/HB 775, by Representative Powell, PASSED. The legislation is now Chapter No. 2015-95, Laws of Florida, effective July 1, 2015. The companion bill was CS/SB 922, by Senator Latvala, J. AARP supported this legislation. • This legislation permits a civil court to appoint a guardian ad litem, attorney ad litem, or administrator ad litem to represent certain persons whose identities are unknown or who cannot be located. • The ad litem has the responsibility to ensure that the absent party's due process rights are considered by the court. See Voting Record for CS/CS/CS/HB 775 p.73; CS/ SB 922 p.75 Property and Casualty Insurance: CS/CS/CS/HB 165, by Representative Santiago PASSED. The legislation is now Chapter No. 2015-134, Laws of Florida, effective July 1, 2015. The companion bill was CS/CS/SB 258, by Senator Brandes. AARP monitored this legislation. • This legislation establishes a uniform 120-day advance written notice requirement for nonrenewal,
cancellation, or termination of personal and commercial lines residential property insurance policies. • Provides that an insurer has to notify a policyholder of the right to participate in a neutral evaluation of a sinkhole claim for the damaged property if the sinkhole claim is submitted within the statute of limitations period, which is two years after the policy holder knew or reasonably should have known about the sinkhole loss. • Creates exemptions to preinsurance inspection requirements for private passenger automobiles. Timeshares: CS/CS/HB 453, by Representative Eisnaugle, PASSED. The legislation is now Chapter No. 2015-143, Laws of Florida, effective July 1, 2015. The companion bill was CS/SB 932, by Senator Stargel. AARP monitored this legislation. The legislation makes the following changes to the Florida Vacation Plan and Timesharing Act: • Revises the definitions for nonspecific and specific multisite timeshare plans and specifies disclosures and other requirements for amendments to timeshare instruments in regards to component sites. • Requires the disclosure of lease terms in timeshare trusts. • If the term of a timeshare plan is extended, requires all rights, privileges, duties, and obligations created under applicable law or the timeshare instrument to continue in full force. • Establishes that termination of a timeshare plan takes effect immediately. The legislation is now Chapter No. 2015-229, Laws of Florida, effective July 1, 2015. AARP supported the legislation. In 2014, Florida voters approved the Water and Land Conservation Constitutional Amendment (Amendment 1) that requires 33 percent of net revenues derived from the existing excise tax on documents (doc stamps) be allocated to the Land Acquisition Trust Fund (LATF) for the next 20 years. Affordable Housing Trust Funds come from receipts from document stamps. The legislation:

Digital Assets: CS/CS/SB 102, by Senator Hukill, FAILED. The companion bill was CS/HB 313, by Representative Fant. AARP monitored this legislation. The legislation would have: • Created the “Florida Fiduciary Access to Digital Assets Act.” This legislation would have authorized a fiduciary to have access to a protected interest’s specified digital assets, including photographs, writings, emails, online accounts and cloud service contents. The fiduciary would have had a duty to comply with the account-holder’s instructions. • Established that legally-appointed fiduciaries would have access to digital assets and tangible assets. AARP opposed this legislation. The legislation would have: • Created a new consumer installment loan with principal amounts ranging between $300 and $2,000 and terms of 6 - 24 months. The annual percentage rate (APR) on these new alternative consumer installment loans would have been generally higher than consumer finance loans under current law. AARP supported this legislation. The legislation would have: • Prohibited manufacturers of contact lenses from instituting unilateral pricing policies (UPP). Consumer Protection: HB 793, by Representative Stark, FAILED. The companion bill was CS/CS/SB 726, by Senator Ring. AARP supported this legislation. The legislation would have: • Required a retail sales establishment to grant a refund, within three days after the date of purchase for goods costing more than $1,000 if returned by a consumer who had been adjudicated incapacitated or who had documentation from a physician of a medical condition that caused the consumer to lack sufficient understanding or capacity to make the purchase. The legislation would have: • Created the “Project Leo” pilot program in Baker, Columbia, Hamilton, and Suwanee Counties to put personal location devices on persons with special needs to assist with tracking in case of elopement. The legislation would have: • Clarified the timeframe to determine the just value of real estate under one of two additional homestead tax exemptions applicable to certain low-income senior citizens. The legislation: • Establishes employer contribution rates in Florida Retirement System (FRS). • Increases the contributions paid by employers participating in the retiree health insurance subsidy program. Punitive Damages: HB 1067, by Representative Santiago, FAILED. There is no voting record for this bill because at its only hearing, the committee Temporarily Postponed it. The companion bill, SB 978, by Senator Richter, never had a committee hearing. AARP opposed this legislation. The legislation would have: • On its date of implementation, capped punitive damages applicable to any case in which a judgment had not been entered.
Livable Communities Traffic Safety: CS/CS/SB 908, by Senator Altman, FAILED. The companion bill was CS/CS/CS/HB 231 by Representative Passidomo. AARP supported the legislation. The legislation would have: • Enhanced the rights and safety of vulnerable users of public roadways, such as pedestrians and bicyclists. • Prohibited assault of bicycle riders, revised provisions for careless driving, and provided penalties for specified infractions contributing to bodily injury or death. See Voting Record for CS/CS/SB 908 p.94; CS/CS/CS/ HB 231 p.96 Use of Wireless Communication Devices While Driving: SB 246, by Senator Sachs, FAILED. SB 192 by Senator Altman, FAILED. AARP supported the legislation. In 2013, legislation was enacted that made texting while driving (TWD) a secondary offense, which means that a violator must be cited for at least one other traffic offense before a TWD offense is prosecutable. This legislation would have: • Made texting while driving a primary traffic offense. • The bill was amended onto CS/SB 1184 by Senator Brandes. See Voting Record for SB 246, p.97; SB 192 p.97; CS/SB 1184 p.98 SB 1022, by Senator Gibson, FAILED. AARP supported the legislation. The legislation would have: • Expanded the current Texting While Driving Law (TWD) by prohibiting dialing, talking, and listening on a wireless communications device for the purpose of interpersonal communication while driving. It also would have prohibited, while driving, use of a wireless device to view or post electronic messages or to initiate a command to the internet. • Provided an exception for conducting wireless interpersonal communication through the use of a hands-free electronic device.
