Chairwoman of the Comprehensive Planning Board Community Members Present: None Supervisor Wasmund called the regular meeting to order at 7:05pm. Clerk Priest distributed oaths of office to all town officials present. Ron Wasmund, Brenda Mallaber, Francis Feth, Paul Stang, James Wojdan, Robert Barber Jr. having taken and signed said oaths to be filed in the town clerk's office pursuant to TL§125. Approval of minutes December 2013 minutes were not supplied to the board by the former town clerk.
Report of town officials Supervisor Ronald Wasmund presented the monthly report on the Town's finances for the month of December 2013. Comprehensive Planning Board Colleen Feth presented to the board the beginning draft of the town's comprehensive plan for 2014. She welcomed comments or revisions from the board as the planning board moves towards completion of the plan. It is in the comprehensive planning boards agenda to have the complete revision of the plan compiled for review and approval in the next few months. Highway Superintendent Robert Barber Jr. shared correspondence from Cattaraugus County in regards to the Multi‐Jurisdictional Hazard Mitigation Plan and asked the board to adopt this Plan. We need to see that last years and this year's money that is budgeted for the loader is allocated for next year seeing that the first payment is not due until 2015. Year 2013 was for 30,000. And 2014 is for 38,000 totaling 68,000 towards principal as of now, leaving a balance of 23,585 plus interest for 2015 budget. Superintendent Barber would like to put a pickup truck out to bid to see if it is feasible to upgrade to a new one. The town's truck will be two years old in June and has 20,000 miles on it. The Highway crew have been working in shop when not plowing snow. He has bought some insulation for the banding around the ceiling in the shop, three more bundles are needed to complete the area, Is it ok to get
them? We need to consider looking at the building this summer and getting some concrete work done on the blocking (striking it). An extensive discussion was had about building maintenance and repairs that need be done. He also suggested the use of a voicemail system or service as opposed to adding an additional phone line for the clerk's office, as both the highway superintendent and the clerks offices' are using the same phone number. Advocacy Day in Albany is March 4th and 5th this year and he is asking to attend again this year. We are asking for more CHIP’s money again as we have in the past. Last year we got an increase of $20,000.00 and we are hoping to get another increase this year. Hotel costs are the same as last year at $145.00. Highway Superintendent School in Ithaca is June 2,3,4th this year and is asking to attend that as well. Hotel costs are the same as last year. RESOLUTION 2014‐1 Cattaraugus County Multi‐Jurisdictional Hazard Mitigation Plan On a motion made by Supervisor Wasmund and seconded by Councilman Feth, the following resolution was APOPTED Ayes 5 Feth, Mallaber, Stang, Wasmund, Wojdan Nays 0 WHEREAS, the Town of Otto, with the assistance from Cattaraugus County, has gathered information and prepared the Cattaraugus County Multi‐Jurisdictional Hazard Mitigation Plan; and WHEREAS, the Cattaraugus County Multi‐Jurisdictional Hazard Mitigation Plan has been prepared in accordance with the Disaster Mitigation Act of 2000; and WHEREAS, the Town of Otto is a local unit of government that has afforded the citizens an opportunity to comment and provide input in the Plan and the actions in the Plan; and WHEREAS, the Town of Otto has reviewed the Plan and affirms that the Plan will be updated no less than every five years; NOW THEREFORE, BE IT RESOLVED by the Otto Town Board that The Town of Otto adopts the Cattaraugus County Multi‐Jurisdictional Hazard Mitigation Plan as this jurisdiction's Natural Hazard Mitigation Plan, and resolves to execute the actions in the Plan. RESOLUTION 2014‐2 Building Maintenance On a motion made by Supervisor Wasmund and Seconded by Councilman Stang, the following resolution was ADOPTED Ayes 5 Feth, Mallaber, Stang, Wasmund, Wojdan Nays 0 Resolved that Superintendant Barber is here by authorized to purchase materials to insulate the truck bay, put in a phone system and begin maintenance on the town hall building. RESOLUTION 2014‐3 Truck Bid On a motion made by Supervisor Wasmund and Seconded by Councilman Wojdan, the following resolution was ADOPTED Ayes 5 Feth, Mallaber, Stang, Wasmund, Wojdan Nays 0 Resolved that the Town of Otto Board authorizes Superintendant Barber to place out to bid a new town pickup truck.
RESOLUTION 2014‐4 Highway Superintendent Training On a motion made by Supervisor Wasmund and seconded by Councilman Feth, the following resolution was ADOPTED Ayes 5 Feth, Mallaber, Stang, Wasmund, Wojdan Nays 0 Resolved that the Town of Otto authorizes the expenses associated with Superintendent Barber's attendance for training at Highway Superintendent School June 2nd ‐4th 2014 and attendance at Advocacy Day in Albany March 4th & 5th 2014. Code enforcement Jeff Hollar reported he had completed two inspections one for a residence on Marek Road and another on Ball Road in regards to a recent co detection concern. He also placed notifications on the Wilder building. He stated that the Town and County Attorneys are looking into what it would take to move the process along regarding the Wilder building. A violation was sent in regards to the accumulation of vehicles at a South Hill Residence. A property owned by Mr. Bartlett has still not put up a privacy fence at J. Hollars' suggestion. J. Hollar has spoken with Judge Austen in regards to enforcement of the Town of Otto Zoning Laws. Stating that Local Law 12.03 has not yet been adopted granting authority to inspect buildings and prosecute offenses. The article in question is 12§12.5 Penalties for the first offense be punishable by a fine not to exceed $350 or imprisonment for a period not to exceed six (6) months or both, that it should be rewritten eliminating the imprisonment clause so that the court proceeding can be handled in a more effective and efficient manner. J. Hollar is willing to rewrite the local law. RESOLUTION 2014‐5 Revision of Zoning Law §12.5 Penalties On a motion made by Councilwoman Mallaber and seconded by Councilman Feth, the following resolution was ADOPTED Ayes 5 Feth, Mallaber, Stang, Wasmund, Wojdan Nays 0 Resolved that the Town of Otto authorizes Jeff Hollar to revise the written language of Article 12: Administration and Enforcement of the Town of Otto Zoning Law §12.5 Penalties to reword the penalty of a first offence violation to exclude imprisonment. RESOLUTION 2014‐6 Audit of Claims On a motion made by Councilwoman Wojdan and seconded by Councilman Feth, the following resolution was ADOPTED Ayes 5 Feth, Mallaber, Stang, Wasmund, Wojdan Nays 0 Resolved that the bills contained on Abstract #001 have been reviewed by the Town Board and are authorized for payment in the following amounts: General Fund No. 1 through 7 $ 1,033.46 Highway Fund No. 1 through 11 $10056.19 Town Clerk No report for December 2013 was presented by the former town clerk. RESOLUTION 2014‐7 Supervisor's Monthly Report On a motion made by Councilwoman Mallaber and seconded by Councilman Wojdan, the following resolution was
ADOPTED Ayes 5 Feth, Mallaber, Stang, Wasmund, Wojdan Nays 0 Resolved that the Supervisor's Monthly report for the month of December 2013 is accepted as submitted. With no further business, on a motion of Councilman Wojdan and seconded by Supervisor Wasmund, the meeting was adjourned at 8:15pm. Carried unanimously.
