Following years of going back and forth between the Grand developer Mick Norcross, and the Southend Council development committee, the latest plans for a conversion of 18 flats, a restaurant, wine bar and health club have finally, officially been approved. The plans to restore and transform the iconic Leigh building were accepted as the vote was won fifteen to two in favour. Many have been following the Grand’s

journey since it was bought by Norcross in 2011 and will be relieved to hear that a piece of Leigh’s heritage will be preserved for many more years to come. The development plans include a wine bar and health club at the basement level, a 144-seat restaurant and brasserie on the ground floor with external raised terrace and outdoor seating, and 18 flats to the upper three floors with a rooftop terrace. With plans to start work as soon as possible, the renovation is expected to take around 18 months.

Our Senior Partner and former President of the National Association of Estate Agents, Richard Hair, reviews the Thorpe Bay property market and how Hair & Son have fared against other estate agents in the area.

Thorpe Bay is very fortunate that unlike so much of the country, there has been very little change to its core, with Thorpe Bay remaining a very quiet and pleasant place to shop – despite now having seven estate agents. As can be seen from the spotlight article, Thorpe Bay has so much to offer and continues to appeal to young and old.

Unlike Southend, Thorpe Bay has been largely unaffected by major construction projects creating an oversupply of new and converted properties. The Burges Estate, with its very useful covenants continues to avoid any huge redevelopments, so helping to retain and improve the property values. The housing market is very strongly governed by the balance of supply and demand. As long as Thorpe Hall Golf Club remains, there is little land left for redevelopment and, hopefully, little chance of Thorpe Bay losing its quiet seaside charm.

Thorpe Bay has always been a little different to the other parts of the town in that it has a special appeal to commuters with the station so central. For younger millennials, there are so many sporting options, and for the more mature home movers there are some of the highest quality bungalows, chalets and flats. It is also very flat, which has its own benefits to the older generation.

Not only has the placement of sockets changed over the years but the shape and type of ‘3-pin’ sockets have also been revised. It is unlikely that many properties have the former round 3-pin socket style, but you may come across such sockets during renovation projects. Sockets at floor level should be raised so they are not damaged by furniture, children’s toys or the vacuum cleaner. It is now customary to have sockets 30 cm above the floor or even higher in bedrooms, kitchens, studies, games rooms or for the elderly or disabled. Sockets can now even include USB points so you are not forever searching for your phone or iPad charger!

Needless to say, rewiring is a messy and disruptive business as it happens in two stages:

WATER & ELECTRICITY DON’T MIX

When showing people around a property invariably they will ask to see the ‘fuse box’, now called a ‘consumer unit’. Apart from Health and Safety reasons, this highlights another important reason for wiring a property correctly. The modern consumer unit will have circuit breakers and residual circuit devices (RCDs). The old fuse boxes used to have wooden backs which could be flammable, so replacing these would be a must. Also, as over the years you would have increased your electric consumption, the wiring and fuses need to be modern enough to ‘carry the load’.

You also now have the opportunity of having your sockets hidden away completely until you need to use them. These can be pop up, flip top, vertical, bridge sockets and many more alternatives. Before you decide which might be best for you, have a look online or check with your local electrical shop to see which of these options would work best for you.

Using electrical equipment anywhere near water is obviously not a good idea unless you have the correct insulation required in place or you use the appropriate plug/adaptor. Hair dryers and straighteners not only could cause an electric shock if they were near water, but could leave unsightly marks on surfaces without any protection. Anything plugged into a 2-pin shaver socket in a bathroom must be the correct voltage to be safe. Again, there will be lots of electrical appliances in the kitchen where you have the risk of using them with recently washed or wet hands. The garden too is a place where water and electrics could unhappily coincide, so please be aware and arrange to have outdoor sockets for all lighting, pond/pool equipment and electrical gardening/shed tools.

Any property that has not had the wiring touched or rewired over the last 20-30 years should consider having some work done. Not because the wiring will necessarily be faulty, but because when the wiring was installed the amount of electrical goods and services run through the wiring, was considerably less than today and therefore reviewing the state of play would be prudent.

As 2017 draws to a close we take a detailed look at the local property market over the last twelve months.

Thank you for giving me the opportunity to give you a brief update on some of the various schemes and projects that are going on within the Southend area.

The Council has also bought the old Gas Works site on the seafront, this will be used to provide car parking and will be an enabler to start our development of the Seaway Car Park. The Seaway development is another regeneration scheme and will be used to provide additional outlets which will help to expand what’s on offer in the High Street but also provide wet weather venues for our visitors and residents alike; part of the scheme will provide a multiplex cinema. The car parking will be replaced within the development and is scheduled in the first part of the project.

Also on Victoria Avenue the old car park, which serves the Beecroft Art Gallery and Jazz Archive, will be redeveloped to provide more car parking to serve the local community and High Street. Following on will be the major redevelopment of the Queensway Estate. This will involve the demolition of the high rise flats, changing the road infrastructure around the estate and covering the underpass so that new pathways, cycle ways and landscaped garden areas will be incorporated to link up with the High Street and to help regeneration of the area. New homes will be built, which include modern flats and town houses; a number of which will be affordable. The whole scheme will take a number of years to complete, but consultation is going on now with the residents, and the Council is looking to proceed using a joint venture working with a developer; the whole project is expected over its lifetime to invest some £3-400 million and will be completed in different phases.

Nearing completion is the redevelopment of the old office blocks on Victoria Avenue which are being converted to new apartments and will help with new living accommodation very close to the town centre. On the opposite side, just off Victoria Avenue, are more new homes being built on the old South Essex College site by Hollybrook, providing more new homes within the town.

Infrastructure improvements on the roads continue. The Kent Elms Junction is near to completion, following delays by various utility companies, and plans are already being progressed to restructure the Bell Junction and apply for the capital funding to alleviate another bottleneck to the town. This will help to keep traffic moving through the town, but also to and from the Airport, with smoother access and egress businesses will find the whole experience more conducive to working within the town. Our long-term plan is to build a new road to the east and we are already working with Rochford as they plan their “Garden Village” housing estate. We are supporting Essex for improvements to the whole of the A13 and A127, and Fairheads Green Roundabout on the A127/A130 has already got approval to increase the capacity. The Council has been instrumental in getting the Government to move forward and get the new crossing of the river at Thurrock/Dartford moving, and start to look at the next crossing further east in about 30/40 years with multi model transport facilities; it will be needed! The Airport Business Park is moving ahead at a great pace, the road into the area has been built and a new roundabout on Cherry Orchard way is completed. We have spent some £3 million already on opening up the site and have been awarded another £19.8 million towards the building of the Innovation Centre; businesses are already interested in taking space within the high-tech business park. The Airport itself is going from strength to strength, and the airport management are improving the experience of travellers regularly, bringing in more outlets and improving the facilities; Easy Jet passengers still rate it very highly and Easy Jet are to station another plane at Southend making it four in number opening up various new routes. Why not fly to the United States from Southend via Dublin, the great part is you clear U.S. Customs and Immigration Control at Dublin savings hours of waiting in the United States.

Find the right tenant - High quality referencing is essential and helps to avoid later problems. Checks include County Court Judgement, Court Decrees, Credit History and Bankruptcy together with a Right to Rent and conversations with relevant personnel such as employers and previous landlords.

Detailed inventory - Over the years, we have developed a very strong inventory procedure and this really comes into its own when there are differences of opinion between tenant and agent as to whether a property has been left as it was found.

Tenancy deposit regulations - Every deposit has to be registered and re-registered every time a tenancy is renewed. Failure to comply can result in a fine of 3x the monthly rent. It will also remove any opportunity to serve a Section 21 notice.

Handling complaints properly - Whatever happens, do not allow the property to fall into disrepair and be aware that a tenant can approach the local authority to complain if there are repairs needed. You have 14 days to respond to a tenant’s complaint.

Ensuring a clean exit for a tenant, whether good or not so good - Ensure you serve Section 21 at the correct time – a minimum of 2 months before the end and not less than 4 months after the start of the tenancy. Note how it needs to be served – preferably not by registered post!

5 MORTGAGE MISCONCEPTIONS EXPLAINED

Mortgage expert, Daniel Edwards,of Affinity Mortgages, gives his take on the latest financial issues affecting the property market.

1. NEW JOB

Sometimes certain circumstances will prohibit you from obtaining a mortgage. However, there are some misconceptions over certain situations where it may seem impossible, when in fact it is entirely possible. Here we debunk some mortgage myths…

I have met with plenty of clients that have not started looking for properties and subsequently lost out as they were under the understanding that they needed to be in a current position to apply. Although the majority of lenders will need at least one month’s payslip, we have lenders that will accept an application based on the fact you are starting a new job. The new start date has to be within 3 months at the point of application and a fully signed contract of employment and letter from HR management confirming said start date and salary would be required.  

2. IN PROBATION IN CURRENT JOB

This ties in with above and again, many clients have not looked for properties until they are out of probation. Again, we have lenders that are happy to lend even if a job has only just started and you’re in probation.  

3. ONE SET OF TRADING ACCOUNTS

In terms of questions about self-employment, this comes up a lot and is a very common occurrence. As long as you have been trading for at least one full year and have either company accounts or tax return figures, then we have lenders who are willing to lend based on this sole year. This will limit the lenders you can go to, so it would be prudent to have 2-years accounts and tax return figures. However, for those looking that do not have the sufficient 2-years…we have the lenders.

4. BUILDERS ON CIS PAYMENTS

The Construction Industry Scheme (CIS) is a tax deduction  scheme which involves tax being deducted at source from payments which relate to  construction work. CIS does not apply to payments made to employees, since payments to employees are covered by the Pay As You Earn (PAYE) system of deduction of tax at source. We have many lenders that will take an average over a certain period. If you are on CIS payments be sure to speak to an adviser as many high-street lenders have strict rules on how they calculate your income.

5. MATERNITY PERIODS

We have seen many clients in this position. It seems that having a newborn falls in line with needing to upsize or move. However, many clients are fearful that due to their maternity pay they will be unable to find a lender. As long as you can demonstrate suitable proof via a letter from your HR department that confirms your return to work date and return to work income, then we have lenders that will take this income as your current and not your maternity or statutory maternity pay (SMP). We would always advise and assess your affordability during the period of maternity to make sure you could afford the payments on a lower wage.

Renting out a Property:

Laurence Cox has been at the forefront of the property market since 1988.

A Landlord’s Legal Responsibilities Whether you’re a landlord or a tenant, renting out a residential property comes with a number of hurdles and deciphering whose responsibility is whose can be difficult to navigate. It should go without saying that the vast majority of landlords are aware of their legal obligations but if they fail to implement some of these effectively, then they run the risk of losing the right to serve a valid Section 21 Notice of Possession. It is therefore imperative to ensure that any rental property is well-managed. Here you can find a list of a landlord’s key responsibilities when renting out a property:

Payment of Rent & Administration Fees It is important to be clear as to what money is being taken from the tenant. For example, advance rent and non-returnable administration fees should not be confused with deposits.

Licensable HMOs If the property being rented has multiple occupants, for example a shared flat or bedsit, then you may need to seek out a HMO licence from your local authority. You should always contact them to discuss their licensing requirements.

Electrical Inspections

Gas Safety If there are gas appliances in the property that are provided by the landlord, the landlord has a duty to carry out annual gas safety checks. These must be performed by an engineer who is registered on the Gas Safety Register and a copy of the gas certificate must be provided to the tenant.

Fire Safety Order There must be a risk assessment in place that complies with the Fire Safety Order. This is only in the case of flats, bedsits and hostels and does not apply to shared houses or single dwelling lets.

Energy Performance Certificates (EPC) An EPC must be in place before a tenant moves into any property and a copy of the certificate must be supplied to the tenant. If this is not provided, you cannot serve a Section 21 Notice in England. Both Landlord and Agent could be liable for a fine for failure to provide an EPC to a Tenant.

Deposit If you take a deposit from a tenant under an Assured Shorthold Tenancy, the deposit must be protected under a Tenancy Deposit Scheme. The tenant should also be provided with a Prescribed Information Sheet within 30 days of paying the deposit.

Carbon Monoxide & Smoke Alarms in Non-HMOs

Again, if your property has multiple occupants then it is likely you will have to provide an electrical safety check by a competent electrician every five years, even if a licence is not required.

Every floor of a property must have a smoke alarm, as well as a carbon monoxide alarm in rooms where there is a solid fuel burning appliance. This is a legal requirement for landlords in England and applies to most tenancies, though there are exceptions.

It is a landlord’s responsibility to ensure that any electrical appliances supplied with the property are safe when the property is being let.

Landlords in England must provide the tenant with an up to date copy of the Prescribed Information Sheet: ‘How to rent: the checklist for renting in England’.

If a landlord fails to perform a risk assessment for Legionnaires’ Disease, they could be issued with a fine. The risk assessment required depends on the type of property and does not always involve extensive water sampling tests.

Christmas shopping is in full swing and Santa Claus is having to be in hundreds of different places, all at once – that’s magic! Regrettably there is no magic wand for the High Street this jolly season. In October both the Confederation of British Industry (CBI) and the British Retail Consortium (BRC) reported that retail sales are falling at their fastest rate since the height of the recession in 2009. October saw a rise of just 0.2% compared with the same month last year, and 2.3% in September. Both organisations draw their figures from different sources, however, both organisations tell the same story of a downward trend in consumer spending. This is negative news for the retail sector in the first month of the crucial run up to Christmas, but good news for shoppers who can expect retailers to discount their goods prior to Christmas. Southend High Street seems to echo out what the CBI/BRC are saying as we have more empty shops or those filled by temporary traders than we have seen for some considerable time. Households are reining back on spending as inflation starts to eat into their disposable income. We are all seeing the price of our weekly shop increase, as well as mortgage repayments following the first increase in interest rates for 10 years to a heady 0.5%. Some of us remember interest rates at 16%, although house prices were not at the level they are today, swings and roundabouts I guess. They too were challenging times.

Businesses and consumers are holding back from making investment decisions because they are waiting to see “what the direction of travel is” once we leave the European Union. We have heard a grim forecast from the Bank of England which estimates that as many as 75,000 jobs could be lost in the financial sector as a result of Brexit. In an effort to try and counter this, both small and large investors alike are seeking investments which provide them with long term income beyond potential challenges of Brexit. Hence investments with a tangible income stream of 10 years or more are realising strong prices. One tiny cloud on that horizon is that, however long the income stream appears to be, even the biggest names on the High Street can go bust – the likes of BHS come to mind.   However, all is not doom and gloom,  at local level it is brisk business as usual in our Commercial Department. Prices for commercial freehold sales are holding up – November saw completion of a sale of a freehold industrial unit in Basildon, the unit was 2650 sq ft and a full mezzanine and on a site of approximately 0.35 acre – our clients realised comfortably in excess of £500,000 for their property. We experienced excellent demand for that property and could have sold at least six more similar premises – had we had that magic wand I spoke of earlier! This was an owner occupier buyer, however many investors are turning to industrial investments to purchase for their pension funds, hence strong prices for such properties are being obtained both by private treaty and in the auction environment.

Legionella Assessment

A landlord must check that a tenant can legally rent a residential property in England. This will apply for all tenants over the age of 18 and will involve checking the original documents that allow the tenant to live in the UK and making copies of these documents.
