Each month, Anita Hair uncovers the best ways to optimise the value of your property so that it achieves the highest sale price possible. This month she considers water features.

Our Senior Partner and former President of the National Association of Estate Agents, Richard Hair gives us some insight into the local property market from 1922 up to the Second World War.

In this edition I want to see how the market developed from 1922 up to the Second World War. The First World War had brought about rapid changes in the social and economic climate, together with major changes in the rental market with the 1915 Rent Act, limiting the level that private landlords could raise the tenant’s rents. In the immediate aftermath of WWI, there were serious concerns about the health and living standards of the men and women returning from fighting for their country but with Lloyd George’s popular campaign to build homes “fit for heroes” standards began to change. Locally there are a number of examples of

these properties built in the mid-twenties such as the development around Canvey Road, Ray Close and Ray Walk in Leigh, all built between 1922 and 1926, once the artisan’s golf course on the Marine Estate had been closed down. Incidentally, 1922 is the date that a new golf course was planned in Vicarage Hill, South Benfleet and opened as Boyce Hill Golf Club. The 1920s also saw considerable growth in privately built housing, much of which benefitted from subsidies given to the private builders. Some of these properties can be seen on the Highlands Estate to the north side of Highlands Boulevard. Between 1920 and 1930 there were about 500,000 new homes contracted with a large rise in home ownership and a decline in the private rental sector. There was no real house price index in those days but recent research has shown a considerable rise in prices with property prices at the end of the decade 55% higher. Consumer prices fell by 30% between 1920 and 1930 which meant an effective increase in prices much closer to 100%. Following the 1929 Wall Street crash, the great depression of 1930/31 led to a period of high unemployment and widespread poverty. However, London and the South East fared better with a mini boom and improving prosperity. A vital factor in the changing housing market was the changing work practices of the public with a much greater emphasis of working families travelling much greater distances to their places of employment than any previous generation. From a high of 9% in 1931 short term interest rates fell to a low of 0.6% in 1933 leading, in the South East at least, to a further rapid increase in construction together with an inclination by the builders to erect higher quality homes leading to the growth of suburbia, particularly in areas with access to rail links to London. Locally you can see this in the Chalkwell Hall Estate, Highlands, Marine Estates and many of the older 1930s built parts of Thorpe Bay. There were just under 300,000 homes built every year in the lead up to the Second World War, far more than has ever been achieved since. What is also very obvious from this period is the considerable improvement in the quality

In my previous article, I took a look back to the housing market from the turn of the twentieth century leading up to my grandfather’s opening of our first office in 1922. It was very interesting to see how the market developed in the early part of the century, particularly the concerns that were being expressed about the increase in the buy-to-let market and the worries about property prices rising too fast!

TYPE There are many types to choose from so it is important to recognise the four basic categories; ponds, fountains, waterfalls and contemporary water features. The options are numerous for fountains, waterfalls, streams, rills, ponds, lakes, solar, wall, wooden barrel with old pump, spheres, tubular, sculptures, crockery and bowl features all made from different materials like glass, copper effect, marble, stainless steel, wood and granite. As we are looking at ‘Value Added’, be careful not to get carried away with an expensive project by adding a lake or swimming pool! These are lovely in the correct landscape but ‘value and added’ might not be how everyone sees them.

BENEFITS A water feature will add aesthetics to a garden landscape, increase the value of your home and also provide a calming, serene and eco-friendly environment that everyone can enjoy. They create sound and movement transforming an outdoor living space into a true place of relaxation and calm. (They will usually be part of a Feng Shui garden for this purpose.)

Leigh bomb damage of the design, construction and finish of these properties, many with larger gardens and garages built in tree lined suburban avenues. In 1929 all the land between what is now Tattersall Gardens and Thames Drive was sold by Gordon Hair for £100,000. This was the largest land deal anywhere in the town at the time. Jack O'Conner, an investor and builder, bought the plot from the Salvation Army. He put the roads and services in and sold blocks of the land to local builders. Based on current values the land alone would probably have been worth about £75,000,000 today! These days, we hear about all the problems of 95% mortgages and buyers taking crippling loans but that is exactly what fed the 1930s building boom with deposits as low as 5% and borrowing doubling in ten years as swaths of tenants became home owners. Other important factors were the easy supply of land with few planning restrictions and a lack of green belt. There were discussions about a green belt around London but this didn’t come into fruition until the 1947 Town & Country Planning Act. The war brought a swift abrupt end to all new building in 1939 with very little building taking place until well into the late 1940s. From my last article and the information above, you can see how the history and development of the Southend area has been greatly influenced by historical events and Hair & Son have been through all of them. I look forward to continuing reviewing how history has affected the local building and housing markets in future issues of H+S, The Property Magazine.

TOP TIP Be careful of small children and babies near any water feature. They are mesmerising to little people as much as to us but they will not understand any risks.

As well as being a water feature for you, ponds can provide a home for natural wildlife like fish, frogs, newts, dragonflies, damselflies and water skaters but you could also have terrapins if you wanted. If space is limited why not buy a water bath for the birds to drink from and splash about in – they love it.

WATER & LIGHT The combination of water together with light is not only magical but uplifting. Sunshine, LEDs, solar, underwater or atmospheric hidden lighting create reflections off plants, rocks, metal walls, shingle or wood landscaped beside your water feature which can produce both amazing sound and movement. Adding stepping stones, bridges or decking can lift you above the water whilst still listening to the babbling/cascading/trickling water glimmering in the light.

THINGS TO CONSIDER You will need to consider water filters, water pumps, outside electrics, clearing the filter and cleaning the feature together with checking that the water level is adequate to run the feature. The features available nowadays are much more ‘user friendly’ than in the past so should be much easier to maintain.

FINALLY Water features add a focal point in your outside space whatever the size and add value to your health and life as well as your home. Wherever you live, you can use plain water to enhance a magical calming atmosphere in your front or back garden or even on a balcony.

The Rich History

of Rayleigh Steeped in history, Rayleigh can be traced back as far as the end of the Saxon period with The Domesday Book demonstrating the presence of a village in 1086. This amazing historical record, drawn up following the orders of King William I, also provides the earliest record of one of the only fortresses in Essex recorded at the time, Rayleigh Castle, now known as Rayleigh Mount. The Windmill, the Dutch Cottage and Holy Trinity Church at the top of the High Street, all also serve as iconic landmarks that allow us to trace Rayleigh’s roots right back to the 11th century. Perhaps one of the most well-known landmarks in the area is Rayleigh Mount. The Mount was built somewhere between 1066 and 1086 by Sweyne, son of Robert FitzWimarc, councillor to Edward the Confessor and kinsman of William the Conqueror. Sweyne was the first Lord of the Manor of Rayleigh and the fourth largest land owner in Essex. The castle would have once served as a defence against the possibility of an invading army marching on to London, however, over its almost 300-year existence, it was never attacked. There is no longer any masonry at the site, however the motte and bailey defence systems are still clearly visible. The castle was abandoned in the 14th century and later became a farm in the 17th century. Several artefacts have been excavated from the site over the years including an Anglo-Saxon brooch, Roman brick fragments, as well as a collection of pottery including shell-tempered cooking pots and jugs. The Mount was given to the National Trust in 1923 who now maintain and preserve the grounds of the former castle. They provide guided walks across the historic sites of Rayleigh (at a donation of just £2

per person) from its Saxon origins through to the arrival of the railway, establishing Rayleigh as the commuter town it is today. Another point of interest is the iconic Rayleigh Windmill. Built around 1809, the Grade II listed windmill stands at an impressive 67ft and milled for 150 years, powered by wind, steam, diesel and electricity. Today, the mill which is located next to Rayleigh Mount, is open to the public with a museum located inside and even acts as a popular venue for weddings and other celebrations. As you travel through the town you’ll also see another popular landmark, the Dutch Cottage located on Crown Hill. Built somewhere between the 17th and 18th century, the 20ft-wide cottage is an unusual octagonal structure with a thatched roof. However, there is a purpose behind this strange shape; its shape makes it relatively easy to thatch and back in the time of its construction when superstition was common, it also provided views in all directions and with no corners, there was nowhere for evil spirits to hide. The cottage takes its name from the Dutch workers who came to Essex to work on the sea defences and are believed to be behind its construction. The Dutch Cottage is occupied, however tours are available with the owner by appointment only on Wednesday afternoons. Two more Dutch cottages can also be found on Canvey Island, also believed to have been built by the Dutch sea wall workers. A historic market dating back to 1181 is still held to this day on Wednesday mornings and with even more history held in Holy Trinity Church where Oliver Cromwell is said to have stabled his horses during the Civil war, Rayleigh certainly has an undeniable sense of heritage. Rayleigh Town Museum is a great place to find out even more about the history and heritage of the town – entry is free but donations are very welcome.

Another momentous month has just passed for many reasons and I cannot let this opportunity pass without making brief reference to the passing of Terence Hair during May. Terence had been at the helm of the Commercial and Management Departments as a Partner and Joint Senior Partner for in excess of 35 years – his enormous knowledge, expertise and professionalism will be greatly missed by all who worked alongside him or knew him in the business community of the town. Our thoughts are, of course, with his family at this difficult time. May also heard the announcement that Havens Department Store in Hamlet Court Road is set to close. Once again the growth of internet shopping marches on and is blamed for the decision to close this landmark store.  John Lewis currently sells about 60% of its products online.  Shopping habits have changed and we no longer visit our High Streets.  It is difficult to see how the flow away from our High Streets can be stemmed. There have been discussions in the property press this month concerning the introduction of a 3% online sales tax which may serve to curb the relentless growth of internet sales.  Such a tax has not, of course, been included in any election manifesto but this must be something for consideration in the future. The election campaign is in full swing and by the time this edition reaches you the General Election will be upon us. All the political parties promise  utopia and one almost expects there to be a money tree growing in the back garden of number 11 Downing Street – not so regrettably! To re-visit a topic upon which I have touched many times before, the UK needs to manufacture, export and create wealth for a strong economy – it is no good to simply spend, spend, spend on imports from the Far East. I made reference last month to the popularity of commercial investments in preference to

residential properties owing to recent changes in stamp duty together with tax changes for non-domicile British citizens.  You usually have to pay 3% over and above the usual SDLT rate if you own more than one residential property, this surcharge does not apply to commercial or mixed use properties. For those of you who may be considering investing in property, the commercial sector is often  daunting and it appears less straightforward to an inexperienced property person. In general terms, an investor can expect a yield of around 5 - 6%, a good commercial tenant will  be more stable, with less void periods and limited or no  responsibility on landlords to affect ongoing repairs. No more telephone calls at midnight asking you to come and change a light bulb!  In short, don't be afraid to consider investing in commercial property. Generally, mixed retail investments are the most popular with investors who are new to the commercial environment, they are perceived as more straightforward. However, the industrial and office sectors are also worthy of serious consideration if you are looking for a solid buy. If you are unsure and don't know where to start we can guide you through the process from finding the right property to  completion of your purchase, with ongoing management of your newly acquired investment. Reflecting on our last auction on the 10th May, I'm pleased to report we achieved another 100% success rate. The auction room was full of keen buyers, clearly interested in the lots on offer. Two of the lots on offer achieved sale prices well in excess of their guide prices –  a former hotel at 25% over the guide and a fiercely fought over garage investment at 40% over. 

It all made for an interesting afternoon! Auctions are quite often seen as the barometer of the property market, so you must say with what is going on around us, with the start of the Brexit negotiations, and a General Election, the market is still looking good for selling properties. The Party Wall etc. Act 1996:

What you need to know Why would an Act of Parliament have ‘etc.’ in its title? The reason is that the Act covers not only works to Party Walls but also other issues. Here our property expert David Plaskow explains some of the other issues associated with the Act.

Property Expert, David Plaskow has over 30 years’ experience in professional property matters both locally and in Essex and is our current auctioneer.

The most common other issue associated and controlled by the Party Wall procedure in the event of a dispute is excavation that is within 3m or, in some cases for deep excavation, within 6m of a neighbour’s building or structures. Even for typically built detached houses in a residential area there is usually only around 2m between the two buildings so work of excavation that is deeper than a neighbour’s structure is very often under 2m away and controlled by the procedure. It is worth noting that it is almost inevitable that neighbouring properties built in the 1930s or perhaps the 1950s have foundations shallower than today’s requirements. The procedure generally came into effect in 1996 throughout the country but had been established in central London for many years. With co-operation, this is a positive arrangement and designed to reduce dispute issues that may have occurred before the legislation had been brought into practice. If works are notifiable, either a surveyor or the owner of a property can serve notice upon their neighbouring owner.  The notice does need to include a number of key pieces of information to be effective.    The neighbouring owners can consent to the works stated on the notice, however, if they are concerned they can indicate that a difference/dispute has occurred. We have to use the word dispute but they are often quite amicable differences and concerns.  Where a difference has arisen a surveyor can be appointed to resolve the matter. This can either be an Agreed Surveyor who acts independently for both parties but is paid by the person who deals with the work.   Alternatively, a neighbouring occupier may wish to appoint their own surveyor and the reasonable costs of their own surveyor will need to be met by the person who owns the building where the development work is occurring. Once a surveyor is appointed an inspection of the relevant parts of the neighbour’s property will be

completed, a Schedule of Condition prepared, together with an agreement known as an Award.   Following the completion of works the same surveyor completes a reinspection of the relevant parts of the neighbour’s building and issues a statement to confirm that either no damage has been caused or if some damage has occurred that repairs need to be completed to resolve the matter or alternatively sets out a cash settlement to cover the costs of putting any damage right.

Excavation at a deeper depth than the neighbour’s structures/foundations that are within 3m or, in the case of very deep foundations, even 6m away from new work.

Cutting into a party structure.  This often occurs when pockets are cut into a party wall for the insertion of a beam to support a new structure e.g. a loft room.

The building of a new wall on the boundary line where none existed before.

MANAGEMENT South Point, Prince Avenue:

How Right to Manage worked for one block in Westcliff-on-Sea In a previous edition we explained what Right to Manage was and how Hair & Son, in partnership with Purco, have now made it much easier for you to achieve through taking care of all aspects of the process and covering all costs. In this edition, we share with you how Right to Manage helped one block in the local area. South Point was built in 2003 and comprises of 24 apartments. When completed, a large national property management company took over management of the block, charging leaseholders a service charge each year. The block was actively managed but over time many leaseholders began to get frustrated with the level of service. Grass cuttings were not taken from site and the plants and shrubs became more and more overgrown. The bin store was not kept clean and tidy and not enough time and effort was spent on site to keep the place looking good. What really frustrated leaseholders was when they received additional demands for money on top of the service charge for works such as redecoration and ad hoc repairs. In one year, leaseholders were asked to pay over £1,000 each on top of the service charge to cover external redecoration. This additional payment became even more frustrating when the redecoration was completed to a below acceptable standard. As each year passed, it also became clear to the leaseholders that a sinking fund was not being built up, so unexpected additional demands for cash became a regular occurrence, especially as the building got older and more maintenance was

required. Communicating with the management company was difficult for many of the leaseholders and rarely led to a positive outcome. Some of the leaseholders found out about Right to Manage, where the management responsibilities of the block are taken away from the freeholder and given to the leaseholders. This sounded great and just what South Point needed. However, when looking into it more, there were some stumbling blocks. It wasn’t as straightforward as it initially looked. To gain Right to Manage it meant involving solicitors. A solicitor for the leaseholders and a solicitor for the freeholder and all the legal costs for both solicitors needed to be met by the leaseholders. It was also going to take a lot of effort to make sure any transition in management didn’t impact on the building or those living there. Contacting all leaseholders, sorting out the new management, contractors, insurance, utilities etc., needed to be actioned. This is where Purco was able to help. Purco took care of the legal aspects, including all the costs. Purco then made sure every effort was made to contact all leaseholders. Once Right to Manage was successfully gained, Purco then made sure all the services were switched over, the building was insured and all the ongoing maintenance and management continued to a high standard. This all happened in 2012. The leaseholders still choose Purco to manage the block today, in partnership with Hair & Son. Since 2012 the whole interior and exterior have been redecorated. All the extraction fans on the roof that service all the bathrooms and kitchens have been replaced. All these works were completely funded from the service charge. No surprise additional bills have been sent to

leaseholders since Purco and Hair & Son took over managing the block. The hallways, car park, gardens and bin store are attended to weekly. Purco meets with a group of leaseholders on a regular basis to discuss what has been carried out and spent since the last meeting and what should be carried out going forward. Each year this group of leaseholders then decide what the service charge amount should be for the following year and what works should be scheduled. The leaseholders at South Point are now in a position where they can decide how their block is managed.  It is up to each leaseholder individually to decide on how much or little involvement they are comfortable with in the decisions that are made. It has worked out well in the end for South Point. The leaseholders own a property in a well-managed block which makes living there much more pleasant and increases the value of the property. Purco have introduced this approach to a number of blocks of different sizes. Purco have been invited back every year to continue managing all the blocks they have helped leaseholders gain Right to Manage on. Purco are really proud of that. Either way we can all look forward to another five years of Government from the winners. Let’s hope that whoever is in charge, they have other matters to concern them, rather than interfering in the housing market. Government has an appalling record of interference in matters such as the old MIRAS tax relief, more recently with the landlord’s tax changes and, of course, the meddling with HIPS. Let’s hope they stay away and leave the market in peace to continue the steady progress.

The annual Leigh Art Trail has become an important part of the town’s cultural calendar. Now in its 20th year, the 2017 event is being held from Saturday 10th – 17th June, and will showcase the talents of over 70 selected artists and designer-makers in around 55 venues in this little corner of Essex.  In what has now become typical art-trail tradition, in the region of 15,000 visitors will be able to view the work free of charge in the makers’ studios, local galleries, shops and restaurants.
