YOUR HELP NEEDED! FEDEX PILOTS' CHARITABLE FUND

The holidays will be quickly approaching us, and we, your FDX MEC, Officers and Staff are asking for your help to support the FedEx Pilot’s Charitable Fund! This Fund is set up to provide monetary support around the world

towards child related activities. In Memphis, the Fund focuses on the FedEx Family House and the Hope House, and in Indianapolis the Fund is engaged in supporting a pilot-themed room at the Peyton Manning Children’s Hospital. The FedEx Family House has housed over 40,000 families since 2010 whose children are facing life-altering medical treatment at LeBonheur Children’s Hospital in Memphis. For over four years FDX ALPA has assisted the FedEx Family House in gathering toys for children. Sadly, the FedEx Family House is telling us that if they can’t get the toys this year they might have to forgo the annual Holiday Village, where the families of children in the House are allowed to pick out toys for Christmas. Our goal is to provide at least 200 toys and a monetary contribution to FedEx Family House. In addition, FDX ALPA has supported the Hope House here in Memphis for over 15 years. Hope House provides high quality early childhood education and social services for over 150 families a year affected by HIV/AIDS, and provides gifts to over 50 families during the holidays. Each year, FDX ALPA has provided a minimum of 15 holiday meals, has adopted a family to bring Christmas joy in the form of clothing and toys, and has provided a monetary contribution to Hope House to support their efforts.

FROM THE GRIEVANCE COMMITTEE: PASSOVER PAY

For those of you who have previously been awarded a B767 crew position, I am sure you are aware that ALPA has filed a grievance on the non-payment of passover pay in certain situations. The grievance was filed on August 18, 2015, with multiple discovery requests. On March 22, 2016, ALPA requested additional discovery information. On March 25, ALPA received the responses to the first batch of discovery requests.

The initial hearing was held on March 30, 2016. ALPA also received the discovery responses from the second discovery request on that day as well. On April 21, 2016, ALPA submitted a supplement document that in essence laid out ALPA’s positions in writing in order to avoid any misunderstandings about the positions. A second hearing was held on May 20, 2016, to discuss that document, and the hearing was held open while both parties exchanged more information. ALPA received some data on prior postings on October 10. On October 11, the parties had a conference on that data, and on November 8, we received additional data on earlier postings. The MEC has received regular briefings on the current status and processing of the grievance, and we have been more than happy to answer any individual questions from pilots who contact us. FROM THE SECRETARY TREASURER

Wet-Lease Penalty Payment Your MEC recently approved a per capita distribution plan for 2016 wet-lease penalties incurred by the company so far this year. Penalty payments were broken into three blocks of wet-leasing activity resulting in the following per pilot payment to be paid on these dates:

In order to be eligible for each penalty payment, you must have been an active pilot during any portion of the dates listed above. For example, if you were an active pilot from January 4th, 2016 through March 15, 2016 and then retired on March 16, 2016, you would be eligible for the first two payments but not the third. An active pilot will be defined as a pilot who was employed by the company during any portion of a relevant time period as described above. Pilots on military leave during all or part of a relevant time period (as described above) will be considered on active status for that relevant period. Pilots on a leave of absence other than military leave status for an entire relevant period will be considered on inactive for that period. Pilots on disciplinary suspension for an entire time period shall be considered on inactive status

for that period.     Payments will be listed as a recruiting bonus on your paystubs and the amounts shown above are gross pay before any deductions. Third Installment of the Lump Sum Retro Payment We are currently working with the company to compute the amounts of the third and last “holdback” installment of the Lump Sum Retro Payment per the Lump Sum Distribution Letter in CBA 2015. The purpose of this last payment was to reserve funds for corrective purposes (challenges and signing bonus categories which were not fully resolved at the time of agreement). The focus of current computations is pilots who were on long-term military leave during the amendable period and whether their bonus category changed upon their return from long term military leave. We have been discussing certain elements of the method of this calculation with the company. In addition, the current 767 passover grievance may result in different bonus categories for some pilots that could also impact the holdback distribution. In this regard, we are now looking into possible recalculations that would be necessary if that passover grievance is successful or otherwise resolved. With that additional proviso, we hope to be able to provide an additional payment from the holdback to the pilots by the end of January 2017. Budget Update Our 2016 MEC Budget was designed to put $1.5 million into our reserve. As of the end of October, we have contributed $3.4 million into our reserve. Your MEC recently passed the 2017 budget and you can view it here. The 2017 budget is also designed to put $1.5 million into our reserve for future negotiations, while increasing spending by 10% due to higher forecasted income for the next year. FDX MEC Resolutions and MEC Meeting Minutes At the most recent MEC meeting, your MEC passed several resolutions and approved meeting minutes from previous MEC meetings.  MEC Officer Elections The FDX MEC recently voted to change the timing of MEC Officer Elections in the FDX MEC Policy Manual. The MEC will elect a MEC Chairman, Vice-Chairman, and Secretary-Treasurer during the next MEC meeting on January 30th-February 3rd 2017. The two-year term of office will begin April 1st, 2017. MEM MD-11 FO NEEDS YOUR ASSISTANCE

First Officer Quentin Chandler experienced a major medical issue on Sunday, Oct 16. As a fairly new crew member at FedEx, he has not had the time to to acquire an extended amount of sick leave to afford

FROM THE MILITARY AFFAIRS COMMITTEE

It has recently come to the attention of the ALPA Military Affairs Committee that several crewmembers have had the processing of their Military Leave of Absence (MLA) notification held up by the company’s Military Affairs liaison. In some of the cases, the crewmember still had R days and Trips displayed on their calendar 3 days prior to the commencement of military duties. This was after the crewmember had submitted the MLA notification well in advance of anticipated military duty. Upon contacting the PAC, these crewmembers were told that their particular MLA had to be reviewed by the company’s Military Affairs liaison. This “delayed” processing of MLA is confusing as it is contradictory to the company’s stated desire in their “MILITARY SERVICE DURING PEAK” FCIF dated 27 Sep 2016: “Also like last year, if military service cannot be delayed, we are asking that you advise us at your earliest opportunity so CRP can adequately plan the staffing of your crew position in your absence. So, if you know you’re going to be on military service during Peak, entering that requirement into our VIPS system as soon as practicable provides the Company the best chance of planning for efficient operations and the best use of our available crewmembers.” Waiting, in some cases over 2 months, to process MLA notifications defeats the ability of CRP to “adequately plan the staffing of your crew position in your absence.” Delaying the processing until just days prior to the commencement of MLA restricts the ability of CRP to efficiently plan the staffing of that assignment, as well as decreasing the best use of our available crew members by allowing others to pick up those flights in Open Time Assignment. In light of recent emails and phone calls to your ALPA Military Affairs Committee, we are providing the following guidance regarding any delays in MLA processing: 1. In accordance with USERRA, the crew member has NO FURTHER OBLIGATIONS other than notifying the company of pending military duty. 2. If your MLA notification has not been processed by 5 days prior to the commencement of your military duty/travel day, feel free to contact the PAC concerning the processing of your MLA. 3. If the PAC cannot assist you, please feel free to contact the Duty Officer and advise him that you will not be reporting for your trip/Rday. Please keep in mind this is just a suggestion. You are not required to follow up on your MLA notification processing. By submitting your MLA Notification, you have fulfilled every legal requirement of USERRA. The protections of USERRA will extend to you if you do not show up for a company assignment while on Military Duty that the company has been adequately notified of, and they have failed to process that notification. For short-notice MLA, continue to contact the Duty Officer if there is not

sufficient time for PAC processing of MLA. An example of this was during hurricane Katrina where members of units in New Orleans contacted the Duty Officer inbound to MEM on a hub turn, and notified them that upon landing they would need to immediately start MLA. As always, continue to contact your ALPA Military Affairs Committee ([email protected]) with any questions or concerns, and thank you for your service.
